Memorial of Deed 511654, Vol 752, pg 519
Memorial of an Indented Deed of Assignment bearing date the 8th
of April 1820 & made between Edward Eustace of Ellengrove in the Co
of Carlow Esq of the one part and Pierce Byrne of Harroldstown in
the said Co Farmer of the other part….. that Edward
Eustace is legally entitled to the Lands & premises mentioned by a
certain Indented Deed of Lease bearing date the 20th day of March
1811 when he Granted to Thomas Dargon that part of the lands of
Rosscatt in Co Carlow Containing 27 acres 1 rod plantation measure
bounded on the East by the high road from Tullow to Newtownbarry, in
the south by Christopher Moore’s land, on the North by Owen Byrnes,
and on the west by Thomas Nowlan’s. To lease to Thomas Dargon from
the 1st of Nov then last for and during the natural lives of Francis
Byrne third son of Thomas Byrne of Kellistown, Richard Murphy second
son of Mathew Murphy of Rainstown and said Thos Dargan who is since
deceased, for 41 yrs at the yearly rent £40 Stg payable half yearly
on every 1st of May and 1st of Nov….. that Edward Eustace, the
Lessor to whom the sum of £40 was paid, agrees to Pierce Byrne to
sell him for the term of lives and years yet to come and unexpired
all his right, title and interest to said lands for £250 Stg and
Edward Eustace in consideration of £250 Stg paid by Pierce Byrne ..…
the yearly rent £40 to be paid to Pierce Byrne for the natural lives
of Francis Byrne and Richard Murphy for the remainder of said term
of 41 yrs yet unexpired… original deed of Assignment was witnessed
by Thos Lawler of Copenagh and Owen Cummins of [Ratheenvills or
Rathemills] both in the Co of Carlow Farmers and this Memorial is
also witnessed by the said Owen Cummins and Peter Doherty of Tullow
in said Co, writing clerk…

The above named Owen Cummins made oath that he is a sub q
witness to the Deed of Assigment of which the above writing is a
memorial
Pierce Byrne said that Owen Cummins was a witness to the
Deed and Memorial
