Names: McCann Vs. The King.

1815.

John McCann of Tullow in the County of Carlow, Yeoman, on the Sixteenth Day of October in the fifty fifth Year of the Reign of our Sovereign Lord George the Third, of the United Kingdom of Great-Britain and Ireland, King, at Tullow in the County of Carlow being a man of disloyal and seditious principles and intending to pervert the loyal subjects of our Lord the King from their duty and allegiance contemptuously, maliciously and seditiously by disaffected seditious speeches and arguments by him then and there uttered did obstruct and hinder the liege subjects of our said Lord the King from enlisting themselves as soldiers in his Majesties army in order to deprive his Majesty of the aid and assistance of his subjects against his enemies to the evil example of all others.

By the Reverend Samuel Roberts, one of his Majestys Justices of the Peace for Carlow.

The Examination of Lucy Mulady ~ who being duly sworn upon the Holy Evaneglists and Examined saith that on the night of Friday the 14th of April 1815 she lodged in the House of James Landiekin of Leighlinbridge, Carlow, and saith that a Woman who calls herself Anne Keenan [ ? ] was put to sleep with her, who a little before daybreak, begged Lucy Mulady to rise and give her a drink of Water, she arose to get it and at her return found the bed Greatly disturbed and her Pocket taken from under the Bolster and Lucy Mulady being Blind felt in her Pocket and found that she had been Robbed of Three Shillings and four pence Sterling, and she is positive that the said Woman and no other Person took the money and further saith that the said Woman is quite unknown to her, and that she does not know her name~~~

[Note added 2012, - a purse was called a "pocket". Reverend Samuel Roberts, Church of Ireland clergyman, was involved in helping the poor of his parish, the following letter from him is in the National Archives of Ireland : Reference CSO/RP/1822/836.

Reverend Samuel Roberts, Leighlinbridge, County Carlow: for advance of public works scheme to build road through Coolcullen mountains.

Letter dated 16th July 1822 from Reverend Samuel Roberts, Coolcullen Glebe, Leighlinbridge, County Carlow, to Chief Secretary’s Office, Dublin Castle, expressing discontent at delay in response to application for aid to help local starving poor by construction of road through Coolcullen mountains; emphasises extent of need of those in locality, many of whom ‘are assembling about my door since six o’clock crying out for food’; in addition he observes ‘now Disease is added to distress’  ‘no less than five died in one House with Typhus fever in the course of a few days’.

Garret McDonald, James McDonald, and George McDonald all of Ballyedmond Maketh Oath that they usually reside at Ballyedmond in the Townland of Ballyedmond in the parish of Hacketstown in the Barony of Rathvilly and in the County of Carlow.

Patrick Conran of Hacketstown Maketh Oath that he is a Householder and has a house where he actually Resides at Hacketstown in the Townland of Hacketstown in the Parish of Hacketstown and in the Barony of Rathvilly and in the County of Carlow and that he is worth the Sum of five pounds Sterling over and above his just Debts and that he Supports and Maintains himself by his Honest indeavours and said farm Michael Neill of Ballyedmond Maketh Oath that he is a Householder and has a house where he actually resides at Ballyedmond in the Townland of Ballyedmond and in the parish of Hacketstown in the Barony of Rathvilly and in the County of Carlow and that he is worth the Sum of five pounds Sterling over and above his just Debts and that he Supports and Maintains himself by his Honest indeavours.

[Note added 2012 -  to explain how the Examination of Maher takes place in November 1815 BUT it appears the trial took place in October 1815, no year is stated on the Jurors return sheet except to state "on the Sixteenth Day of October in the fifty fifth Year of the Reign of our Sovereign Lord George the Third".

King George was crowned King on 25th October 1760 - so up to 25th October 1761 was recorded as the first year of his reign, hence October 1816 was the 55th year of his reign simple (or what?).]

Examinations of Thomas Maher, Sergeant of his Majesties 101st Regiment of Foot now on the recruiting Service in the Town of Tullow in Carlow taken before Edward Eustace of Ellengrove, Esquire one of his Majesty's Justices of the Peace for the County of Carlow.

Thomas Maher who being duly Sworn on the Holy Evangelists and examined deposeth that on the 16th day of October 1815 he saw a crowd about Michael Hyland's door in Tullow, he went down to see what was the matter when John McCann of Tullow in a Violent manner came up to him and desired him to quit the Street which he refused to do.

Thomas Maher further Saith that McCann there upon in a loud voice called him a Crimp Sergeant and warned the people not to enlist with him saying that they were not for his Regiment but ~ that would be sent off and never heard more about.

That on the day following about the hour of Twelve O'Clock Thomas Maher was with some of his party of soldiers passing through the Town of Tullow when he was followed by said McCann who in a loud voice warned the people not to enlist with him and asked him was he going again to Crimp.

And again in a few days after, he met McCann in the street he gave him the same language.

Thomas Maher is Convinced that the Conduct of McCann was to injure the recruiting Service in Tullow as Many who seemed disposed to enlist having declined allegding they would be sent to the depot in Waterford and from there to battle overseas and not allowed to return.

 Thomas Maher also Saith that McCann also abused him and called him a Rascal.

Judith Malone maketh Oath that she usually Resides at Rageran in the Townland of Rageran in the Parish of Ballymurphy, Barony of Idrone East, in the County of Carlow.

(signed) Judith her X mark, Malone.

Be it remembered that the above-named Judith Malone is Indebted unto our Sovereign Lord King George the Third, in the Sum of £10 Sterling and shall appear in her proper Person to Prosecute Walter Cummins of Inchenfookey for an assault and a rape.

Sworn before ME at Montgerald, Carlow this 18th Day of February 1815. Fitz Gerald.
