Violent Threats!

The Information of Nicholas Tool of Scotland Parish of Hackets Town Barony of Rathvilly, County of Carlow taken before Thomas S. Dennis and Barth. Warburton Esqes. two of Her Majesty's Justices of the Peace.

Nicholas Tool sworn on the Holy Evangelists, saith That on the 8th day April 1844 - I received Possession of a Farm ( from John Jones Esq. of Newtown, Co. Wicklow) - Part of the lands of Eagle Hill in the County of Carlow and after getting possession of said Lands I was followed in a most Violent and outrages manner by Joseph Codd who was armed with a Drawn Baynot and He Swore in a most violent manner that he would take my life if I interfered with said Land - and I verily believe If It was not for the interference of said John Jones and others who took said Baynot from Joseph Codd that I would lose my life - when I was going away and after He Joseph Codd had been deprived of his Baynot  He followed me with two Stones - His mother also followed me and took hold of me by the two Ears and used most Violent Threats - and Since I am affraid to use authority over said Farm ~~

The Jurors of our Lady the Queen, upon their oath present that one Nicholas Tool late of Scotland in the county of Carlow ...?... on the Eight day of April in the Seventh year of the Reign of our Sovereign Lady Victoria, was seized in his demesne as of fee, of and in a certain messuage with the appurtenances there situate, and that Joseph Codd, Yeoman and Mary Codd, Married Woman both of Eagle Hill in the County of Carlow. while said Nicholas Tool was so seized of the said messuage with the appurtenances as aforesaid, and was peaceably possessed thereof into the said messuage with the appurtenances with force and arms, and with strong hand unlawfully did enter and the said Nicholas Tool from the peaceable possession of the said messuage with the appurtenances then and there, with force and arms, and with strong hand unlawfully and injuriously did expel and put out, and the said Nicholas Tool from the possession thereof so as aforesaid with force and arms, and with a strong hand being unlawfully expelled and put out the said Joseph Codd and Mary Codd from the said Eight day of April in the year aforesaid until the taking of this inquisition, the said Nicholas Tool from the possession of the said messuage with the appurtenances with force and arms and with strong hand unlawfully and injuriously then and there did keep out, and still doth keep out, against the form of the Statute in that case made and provided , and against the peace of our said Lady the Queen her Crown and Dignity.
