Part of the LANDS of MAHON (held under Lease for 20 years, renewable for ever)
situate in the COUNTY of CORK; and part of the LANDS of BALLINAMOUGHT, held for
the residue of a term for 900 years, situate in the CITY of CORK; and HOUSES and
PREMISES situate on the GRAND PARADE in NILE-STREET, JAMES-STREET, NICHOLAS-STREET,
GEORGE'S STREET, MALLOW-LANE, RUTLAND-STREET and MONTPELLIER-TERRACE.

One o'Clock in the Afternoon.

at Mr, William MARSH'S Sale Room, and the will be submitted to Mr. Commissioner
LONGFIELD at his Chambers on Tuesday the 20th of November, 1855 at Eleven o'Clock
in the forenoon, without further notice to any person.

CONDITIONS OF SALES AS TO ALL THE LOTS
That the purchaser shall not be at liberty to require evidence of, or object to,
the title of the Lessors under whom the Lands are held, or to object by any reason
of any imcumbrances affecting their Estates.

DESCRIPTIVE PARTICULARS OF LOT No. 1
That part of the lands of GRANGE, now offered for sale, is situate adjping the
village of DOUGLAS, ( about two miles from the City of CORK) Parish of CARRIGALINE,
and COUNTY of CORK.

This part of the Lands of GRANGE, is held under a Lease, bearing date 17th of April.
1730, made between Connell VERCKER, of the one part, and George WALLIS, of the other
part. which granted and demised the Lands and Premises therein referred to, for the three
lives therein named, and contained a covenant for perpertual renewal thereof, subject to
the yeary rent of £10 10s. 0d.. then currency equal to £9 13s. 10 1/4d. of the present
currency. payable half-yearly every 29th September and 25th of March, and also subject
to the dues of two fowl or 2s.6d, then currency, equal to 2s. 3 1/4d. of the present
currency, in lieu thereof, on the 1st of November in each year.  The Lease reserves a
renewal fine of £5 5s. late currency.equal to £4 16s 11d. present currency, on the fall
of each life, and contains the covenants which have ordered to be inserted in the
fee-farm grant hereinafter set forth.


The original of said Lease was lost, but an old copy, attested to by a Notary Public,
on the 13th October, 1762 is lodged in Court, and the subsequent renewals 0f 27th of
August, 1763 and 1st of March, 1801 recite such said Lease.

The Commissioners have, by order bearing date the 14th of May, 1855 directed that said
Lease shall be converted into a fee-farm grant on the following terms: that is to say
1st: That the fee-farm rent, in respect of said Lease, shall be the yearly sum of
£10 0s 7d., in lieu of the present rent, £9 13s. 10 1/4d and of the dues of two fowl,
2s.6d, then currency, equal to 2s. 3 1/4d.in lieu thereof, and of the renewal of fines,
rights and reservations thereby commuted, and the following covenants which are
contained in the said original lease of the 7th day of April, 1730, and the said renewals
of 1763 and 1801 are to be deemed and taken as still subsisting between the owners of
said lands and the owner of said rent, and are to be expressed in any conveyance
which may be executed by the Commissioners of said Lands; that is to say -- covenant
on the part of the owner for said lands, for payment of the annual rents, to be there
by reserved; covenant that the owner of the lands shall preserve and keep the premises
and all improvements in good repair, and yield them up in such condition; covenant on
the part of the owner of the rent to allow the owner of the land peaceably enjoy same;
clause to empower the owner of the rent to distrain; also of re-entry in case of no
suffienct distress. And the better to carry into effect the said directions as to the
continuing of said several covenants, the Commissioners have ordered that a Deed of
Covenant shall be entered into cotemporaneons with the conveyance by the Commissioners
to observe all such covenants aforesaid.

TERMS OF LEASE: [Roche] LEASE dated 5th of September, 1765 from John RADCLIFFE to
William CONNELL, for lives renewable for ever, last renewal dated 2nd January, 1836
to Edward ROCHE and Thomas DENNEHY, for lives of Jonas LANDER, Edmond ROCHE and
Michael O'Brien O'DRISCOLL at the yearly rent of £10 late Irish currency, subject to
a renewal fine of £5 late currency at the fall of each life; and if the lessees should not
pay the said renewal fine of £5 within 6 months after death of the life, and should not
nominate a new life within six months, that then it should be lawful for the lessor to
refuse to add or nominate any other life or lives than those then in being;
renewal to be taken out within six months after the death of life and a fine of 5s. late
currency for every month after the six until renewal taken out.

[Observations as noted: The original lease of 5th of September, 1765 is not forthcoming,
but it is recited in a Renewal of 27th April, 1802, the original of which can be handed
to the Purchaser.]

DESCRIPTIVE PARTICULARS OF  LOT No. 2

The premises at KINSALE consist of a capital Dwelling House and Garden with Stables and
Out-offices attached, very recently built situate in the Cove of KINSALE; and a Dwelling
House and Yard, situate in Cork-street in the Town of Kinsale, Barony of Kinsale, and
County of CORK. The house and premises in No 2 are held in fee-simple.

The House and Garden No. 1 are held under a lease bearing date of 7th July, 1747 made
between Right Honorable Edward SOUTHWELL, of the one part, and Mary Anne RIORDAN, of the
other part, which granted and demised the house and plot of therein referred to, for 99
years, from the 25th March, 1747 provided the three lives therein named should so long
live, and contained a covenant for perpetual renewal thereof, subject to the yearly rent
of 10s. late currency equel to 9s. 2 3/4d. present currency, payable half-yearly on the
feasts of St. Michael and the Annunciation.  The Lease reserves a renewal fine of 5s. late
currency equal to 4s. 7 1/2d. present currency on the fall of each life, and contains the
covenants which have been ordered to be inserted in the fee-farm grant hereinafter set forth.

The Commissioners have, by order bearing date the 9th of May, 1855 directed that said
Lease shall be converted into a fee-farm grant on the following terms: that is to say, 1st
that the fee-farm rent in respect of said lease shall be the yearly rent of 10s in lieu  of
the present rent 9s. 2 3/4d. and the renewal fines, reservations and agreements thereby
commuted; and the following clauses and convenants which are contained in tne said original
lease of 7th day of July, 1847 are to be deemed and taken as still subsisting between the
owners of said lands and the owner of said rent, and are to be expressed in any conveyance
which may be executed by the Commissioners of said Lands; that is to say -- covenant
on the part of the owner for said lands, for payment of the annual rents, to be there
by reserved; covenant that the owner of the lands shall preserve and keep the premises

and John LANDER SHOULD SO LONG LIVE with at the yearly rent of £3 12s. late currency,
covenant of perpetual renewal with payment of 5s. like currency on the fall of each life.
