E. by John CROWE, 19 Cook Street, Cork _____________________________________________________________________________________ GENERAL INTRODUCTORY OBSERVATIONS AS TO LOTS Nos. 11, 12, 13, [as grouped] and Lot. No. 14 [Edited and Condensed where possible] The lands of FARRANMACTEIGHE are within a mile of the City of Cork, on the Western Road and are on the banks of the River LEE. There are upon them a large number of valuable houses and buildings and the undertenants have, in almost every case; large interest in their holdings, the valuation of lands being very nearly double the rental. The Lands of these lots have been held under ONE lease, from the BISHOPS of Cork and the ECCLESIASTICAL COMMISSIONERS at a Gross Rent of £23 6s 2d and fees, but for the purpose of the sale in this matter have been divided into three holdings, and a distinct lease of each obtained, with the rents apportioned accordingly. LOT 11 is valued at: £174 - LOT 12 at £185 and LOT 12 at £335: The annual fine paid to the ECCLESIASTICAL COMMISSIONERS for renewal of these lands was £53 6s 1d for the sale now divided between 11, 12 and 13. in the proportion of the valuation above. gives the future renewal estimate as follows: Lot 11, £13 7s 4d - Lot 12, £14 4s 2d and Lot 13 £253 14s 7d The Gross tithe rent-charge is £10 18s 10d. A copy of the applotment has been obtained which shows' Lot 11 as £3 5s 7-1/2d; Lot 12 as £3 19s 1 and Lot 13 as £3 14s 1-1/2d. The letting of Lot 11 having been made since the passing of the Act of 1st and 2nd Victoria, chapter 109 (tithe rent-charge Act) will be payable by the purchaser. The original letting of No 2 on LOT 12 was prior to the passing of that act, and up to the period of agreement of 24th April 1850, the tenant £4 with the rent as the tithe rent-charge. and this is now included in the rent now payable out of that holding. [LOT 11] and is not reserved as rent upon the renewal of the lease. The tenant [No 1] on Lot 12 pays £2 3s 6d Tithe rent-charge, but is not reserved as rent upon the renewal of the lease. The tenant No 2 [Lot 12] pays 13s 6d which is reserved as rent by his last renewal of the 4th June, 1853. ________________________________________________________________________________ Rental and Particulars LOT 11 Griffith's Valuation for this Lot is £124 [Edited and Condensed where possible] Part of the of lands of FARRANMACTEIGHE, in the Barony of Cork, County of Cork, in the Parish of Saint Finn Barr's containing about 48 Acres with yearly rent of £5 16s 10d paid to ECCLESIASTICAL COMMISSIONERS of Cork Producing a Yearly Profit of £92 9s. RENTAL -- LOT No. 11 GALE DAYS 25th March and 29th September DENOMINATIONS TENANTS NAME YEARLY RENT FARRANMACTEIGHE, Thomas JENNINGS £101 16s 0d in the Barony of Cork NATURE OF TENANCY: [JENNINGS] LEASE dated 14th May 1850 by Sir William Abraham CHATTERTON. to to Thomas JENNINGS and renewal dated 11th June, 1857 by Henrietta Georgiana Marcia CHATTERTON and Sir James CHATTERTON to Thomas JENNINGS for the term of 19 years, from 25th March, then last past, at the yearly rent of £2 5s. for every acre save 2 allowed for waste and severance caused by a new line of road through said lands; also excepting to the Bishop of Cork, all gorts and glebe lands and also excepting to said Bishop and all successors with liberty to enter and take all waifs, estrays, felon's and fugitive's goods and all woods and underwoods on the demised premises save such the said JENNINGS and his heirs, assignees etc shall plant. All Bog timber and also all royalties, mines, minerals, quarries of stone and coal found or to be found, as well as the liberty of fishing, fowling, hunting &c and to hold court leet and courts baron thereon, containing the usual covenants between Landlord and Tenant, and a covenant to do suit and service to the said Bishop, and to perambulate and maintain the bounds and to present enroachments and mutual covenants for renew 'toties quoties' without additional rent or fine, unless the fine to be paid to Bishops should exceed £53 6s 1d, or if such not paid in six months after notice in writing. The lessor will not be bound to renew further but might resume possession at the termination of the then existing term. There is a clause of surrender at the end of any third year for the term upon giving six months notice. Further in to the Descriptive particulars are noted: Lease 12th of May 1857, that yearly rent of £51 16s 10d over and above all quit rent, crown rent, contributions, county charges, taxes and impositions payable quarterly with 1s in the pound, receiver's fees. The releases in the leases note any listed exceptions were enjoyed by the Bishopric and its members since the year 1688. There is a restriction the "Sir James CHATTERTON should not alien, sell or assign his lease, interest or title to the premises, to any person or persons whatsoever, other than his own family, unless licensed by the said Commissioners and their successors under common seal, under a penalty of an additional rent." The purchaser will not be penalized for any such alienation. This lease also requires the tenant to sow as much hemp and flax as the statute requires as well as perambulate the bounds and maintain the fences.
