Will: Macartney, James February 13, 1843 *********************************************** Ireland Genealogy Projects Archives Dublin Index Copyright ************************************************ File contributed by: Rosalind Dunning ros.dunning@outlook.com February 2, 2019, 1:43 pm MACARTNEY, JAMES FEBRUARY 13, 1843 Source: National Archives Kew England Written: February 13, 1843 Recorded: February 2, 2019 Extracted from the Registry of Her Majestys Court of Prerogative in Ireland I James Macartney of Upper Merrion Street Dublin Doctor of Medicine do make publish and declare this my last Will and Testament in manner following I give and devise to my Wife Sarah Macartney during her natural life the following lands tenements and Premises Vist. my Lands at Tullylegg and my lands at Druminay both situated in the Parish of Donaghhenry and County of Tyrone my portion of the Town land of Aughanore with the field in Tullyelmer both situated in the County of Armagh my Lands of Mallaghbane part Dromorgan and Tenements in Hamiltonsbawn situate in the Manor of Johnston and County of Armagh my Lands of Drumgan in the Parish and County of Armagh and my freehold Tenement and house in North Street in the Town of Newry and after the death of my said Wife Sarah Macartney I leave and devise the aforesaid lands tenements and Premises in the following manner 1st my Lands at Tullylegg situate in the Parish of Donaghhenry and County of Tyrone I give and devise to my Nephew the Reverend James Macartney and to his heirs and assigns for ever 2nd my portion of the Townland of Aughanore and my field in Tullyelmer both both situated in the Parish and County of Armagh I give and devise to my Nephew Dr Harvey(?) Macartney Doctor of Medicine and to his heirs and assigns for ever 3rdly my Lands of Mallaghbane part Dromorgan and Tenements in Hamiltonsbawn in the Manor of Johnston and County of Armagh I give and devise to my Niece Mary Anne Macartney and to her heirs and assigns for ever 4thly my lands of Drummay in the Parish of Donaghhenry and County of Tyrone I give and devise to my Niece Catherine Macartney and to her heirs and assigns for ever lastly my Lands of Drumgan in the Parish and County of Armagh together with my freehold Tenement and house in North Street in the Town of Newry I give and devise to my Nephew Robert Charles Atkinson Barrister and to his heirs and assigns for ever I leave and bequeath to my Niece Sarah Wife to Hugh Carlile M.B, and to her Executors Administrators and Assigns my house No 35 in Upper Merrion Street in the City of Dublin I also give and leave to my said Niece Sarah Carlile and to her Executors Administrators and Assigns such portion of my Annuity of one hundred pounds per Annum granted to me for the period of ten years by the University of Cambridge which shall become due and payable after my death I authorize and empower my Executors or the survivor of them on the event of my death to sell out all the Principal Stock standing in my name in the Irish funds both in the new three and a half Per Cents and in the Consols and I will and direct that my said Executors or their survivor shall as soon as practicable appropriate the money produced by the sale of my Stocks together with the bond debt due to me by Brook Taylor Ottley for five hundred pounds any money Debentures and Chattels of which I may die possessed in the payment of the following legacies after discharging the Expences of proving this Will and of my funeral 1st I give and bequeath to my Nephew Marcus Macartney the sum of twelve hundred pounds and also to my Nephew Carleton Edward Atkinson I give a like sum of Twelve hundred pounds 2 To each of my five following Nieces Vist. Mary Anne Macartney Catherine Macartney RoseWife of James Reid Sarah Wife of Hugh Carlile and Emily Wife of James Atkinson I give and bequeath the sum of five hundred pounds 3rd to each of my three Nieces Vist. Jane Atkinson Eliza Atkinson and Sarah Atkinson I give the sum of Seven hundred pounds 4 to each of my two grandnieces Mary Alpherts and Barbara Alpherts I also give the sum of Seven hundred pounds 5 I leave the sum of one hundred and fifty pounds to bear the expences of publishing a Memoir of my life with such writings of mine as are already printed in the transactions of Societies and also such original facts and observations as may be worthy of collating from my private papers to any competent person or persons who may be chosen to undertake this and who shall be chosen to undertake this and who shall execute the same I wish to leave the profits arising from the sale of such book if any And I further leave one hundred pounds as a remuneration to him or them for the trouble 6. I leave to my Wife Sarah the sum of Two hundred pounds for her immediate use on my death 7. Such Parts of my Plate Linen and Household Goods as my Wife may wish to possess I leave to her during her life but ultimately I wish all my Plate to belong to my Nephew the Reverend James Macartney with the exception of the silver Cup given to me by my Pupils which I wish to be sent to John Greene Crosse Norwich Surgeon 8 I leave one hundred pounds to my Grand nephew Charles Woodward Junior on the condition of his undertaking the burthen of being an Executor 9. I leave my medical books and plates to my Nephew Doctor Maxwell Macartney and my books on general subjects to my Nephew Robert Charles Atkinson Lastly I leave all the Residue or Remainder of my money Goods and Personal Estate to my Niece Sarah Carlile I constitute and appoint my Nephew Robert Charles Atkinson Barrister my Grand nephew Chalres Woodward Junior Solicitor and William Alperts of Dartry Lodge in the County of Armagh as my Executors to carry into effect the purposes and intentions of this my last Will and hereby revoke all former Wills made by me and declare this to be my only true last Will and Testament In Witness whereof I have hereunder set my hand this thirteenth day of February in the year one thousand eight hundred and forty three James Macartney (Attestation Clause) Edward Clibborn 14 Grafton Street Dublin - John Anster of 96 Lower Baggot Street Dublin Proved 11 April 1843 Proved at London 30 August 1843 to Charles Woodward power reserved to other Executor Prob11/1984
