Wills: Usher, William May 5, 1774 *********************************************** Ireland Genealogy Projects Archives Kildare Index Copyright ************************************************ File contributed by: Rosalind Dunning os.dunning@outlook.com February 25, 2018, 1:06 pm WILLS: USHER, WILLIAM MAY 5, 1774 Source: National Archives Kew England Written: May 5, 1774 Recorded: February 25, 2018 Extracted from the registry of His Majesty's Court of Prerogative in Ireland In the Name of God Amen I William Usher of Athy in the County of Kildare Doctor of Physick being in a declining state of health but of sound and disposing mind and memory do make this my last Will and Testament in manner following that is to say first I commend my Soul to God and my Body to the Earth to be buried in a decent but prudent manner by the directions of my Executrix hereinafter mentioned my worldly substance wherewith God hath been pleased to bless me I dispose of as hereafter follows I give and bequeath to my Daughter Elizabeth Davis otherwise Usher one hundred Pounds Ster. I give and bequeath to my Daughter Margaret Usher the like sum of one hundred Pounds Ster. And to my Dearly beloved Wife Elizabeth I give and bequeath the remainder of what worldly substance I shall die possessed of and I make constitute and appoint my said Wife Elizabeth sole Executrix and residuary Legatee directing and appointing that such said part of my Worldly substance as she shall be possessed of at the time of her Death shall be given to my before mentioned Daughters in such manner and Proportion as my said Wife shall think most Proper or as they or either of them or their Issue shall best deserve from her in her own Opinion and not otherwise and think it incumbent on me to assign my reason for vesting the said trust and confidence in my said Wife as I am convinced of her prudence and discretion and as I am beholden to her and her family for the principal part of my present Possessions In Witness whereof I have hereunto affixed my Name and Seal this fifth day of May 1774 four William Usher (Attestation Clause) Gerald Fitzgerald _ Robert Johnson I the above named William Usher do make this Codicil to my Will declaring it to all intents and purposes as part of my said Will that is to say considering that my dear Wife is in a weak state of health do appoint my Son in Law Richard Davis and Mr Edward Curtis of Fishamble Street Apothecary also my Executors and I direct that if my said Wife should die before me or without making a Will that all my Worldly substance of whatever sort be equally divided between my Daughters Elizabeth Davis and Margaret Usher if my Daughter Margaret shall be married or arrive to the age of twenty one Years if not the whole to be the Property of my said Daughter Elizabeth for her own use and her Issue my plate furniture and stock I leave to my Daughter Elizabeth but to be accountable thereout to my said Daughter Margaret for the Sum of one hundred and fifty Pounds nothing herein contained to lessen the Trust I have herein before reposed in my said Wife if she outlives me and if my said Daughter Elizabeth should die without Issue I direct that what she is hereby intitled to shall revert to my Daughter Margaret In Witness whereof I affix my Name and Seal eighth day of May 1774 four Willm Usher Gerald Fitzgerald _ Robert Johnson Proved 24 December 1774 to Richard Davis Proved at London with a Codicil 29 December 1786 to Richard David the surviving Executor PCC Prob11/1148
