NEWSPAPER: BREACH OF PROMISE, HOGAN VERSUS MAHER, 1859

Court of Common Pleas.
Breach of Promise of Marriage.
HOGAN versus MAHER.

Mr. White moved on behalf of the defendant for
liberty to plead double matter. The action was
brought to recover damages for breach of promise of
marriage, the plaintiff being the Gentleman, and the
defendant the lady in the case, both parties residing
in the County of Kilkenny. The Plaintiff, counsel
stated, alleged a breach of the usual promise to
marry, with special damages, the gentleman alleging
that he incurred certain expenses incidental on a
change of life.

Judge Hall---What is the change of life?.

Mr. White---He made preparations for the wedding
feast, the publication of the Banns, the special
damage in respect of which he estimates at ?20, and
the general damages in respect of the Breach of
Promise at ?120.

Judge Ball--That is measuring the extent of his
grievances pecuniary speaking, pretty closely.

Counsel said that the pleas sought to be pleaded
were that the promise was rescinded by mutual
agreement of both parties, and a plea to the effect
that after the making of the promise, and before any
breach by the defendant, she discovered the
defendant had a bad temper, etc. Judge Ball asked if
a plea that the plaintiff had a bad temper, with other
matters, was a good defence to an action for breach
of promise of marriage.

His Lordship extended the time for pleading in the
case for four days for the purpose of allowing
affidavits to be filed.
