Reciting an Indenture bearing date the tenth of August One thousand Eight hundred and thirty five and made Between Daniel GABBETT of the City of Limerick Esquire of the one part And John ODONNELL JOYNT of Catherine Street in the City of Limerick merchant of the other part and that for the Considerations mentioned therein the said Daniel GABBETT demised to the said John ODONNELL JOYNT All That and Those the four several lots of Ground marked respectively Numbers Two, Three, Four and Five in the Map on the back thereof situate lying and being in that part of Newtown Pery then called Brunswick Street in the Parish of Saint Michael and South Liberties of the City of Limerick containing in the whole One hundred and one feet in front of said Street and seventy four feet be the same more or less in the rere or depth and open backwards to the Stable lane which was thereby reserved to the said Daniel GABBETT his heirs and Assigns as a free passage at all times of Sixteen feet wide and also as a free and open passage to and for the said John ODONNELL JOYNT his heirs and assigns and to the other tenants to the remaining lots of said ground To hold Same as therein unto the said John ODONNELL JOYNT his Heirs and Assigns at the yearly rent therein And Reciting that said John ODONNELL JOYNT departed this live in the year One thousand Eight hundred and forty Six whereby he devised to said Edward JOYNT his Estate and Interest in that part of the Concerns which he held under Said Daniel GABBETT by said recited Lease comprising the Dwelling house yard and part of the store all standing and built upon said Lot Number Two in the Lease from said Daniel GABBETT to Testator being portion of said demised premises subject as therein and said Testator devised to his wife Mary JOYNT the remaining Lots Number Three Four and Five in the said recited Lease of the tenth August One thousand Eight hundred and Thirty five mentioned and described on the map attached thereunto subject as therein. And Reciting that the last will of said Mary JOYNT bearing the date the [blank space] day of [blank space] devised unto her said Son James ODONNEL JOYNT the house and stores situate in Brunswick Street in the City of Limerick and which House and stores are built upon the lots Numbered Three Four and Five therein before mentioned And Reciting that said James ODONNELL JOYNT had agreed with the said Dudley JOYNT to assign to him his share of the said premises for the considerations therein after mentioned. And Reciting that said Edward JOYNT had also agreed to assign to said Dudley JOYNT his remaining share of the said premises for the considerations herein after mentioned. The said Deed of which this is a Memorial witnessed that in consideration of the sum of One hundred and fifty pounds paid by the said Dudley JOYNT to the said James ODONNELL JOYNT and also in consideration of the sum of Five hundred pounds paid by the said Dudley JOYNT to the said Edward JOYNT they and each of them granted bargained sold assigned transfered and made over unto the said Dudley JOYNT and to his heirs and Assigns All That and Those the four several Lots of Ground Marked respectively numbers Two Three Four and Five on the map on the badk of said Original Lease situate lying and being in that part of Newtown Pery now called Brunswick street in the Parish of Saint Michaels and south Liberties of the City of Limerick Containing in the whole One hundred and one feet in front of said street and Seventy four feet be the same more or less in the rere or depth backwards to the stable lane which was thereby reserved to the said Daniel GABBETT his heirs and assigns as a free and open passage at all times of Sixteen feet wide, and also as a free and open passage to the said Dudley JOYNT his heirs and assigns to the other tenants to the remaining lots of said Ground. To Hold same unto the said Dudley JOYNT his heirs and assigns for and during the life and lives of James JOYNT Dudley JOYNT (party thereto) and Galbraith JOYNT and for the longest liver and survivor of them being the lives mentioned in said Lease and also for and during the natural life and lives of such other person and persons as should from time to time for ever thereafter be added pursuant to the Covenant for Renewal Contained in said Lease and subject to the payment of the rent and performance of the Covenants contained in said Lease to be paid and performed and which said deed contained other Covenants and Clauses and which said deed and this Memorial as to their due execution by the said James ODONNELL JOYNT and Edward JOYNT respectively as witnessed by Richard ROCHE and James MURPHY of Brunswick street in the City of Limerick Pawnbrokers clerks.
