December 2, 2017 Extracted from the Registry of Her Majesty's Court Prerogative in Ireland In the Name of God Amen I Richard Barry of Rathcreagh in the Barony of Lower Connelloe and County of Limerick Gentleman being in perfect health and of sound mind memory and understanding thank God but considering the uncertainty of this mortal life do make and publish this my last will and testament revoking all former will or wills codicil or codicils heretofore by me made in manner and form following first offering my Soul to God Whereas I am possessed of certain property to wit a sum of five thousand pounds standing in my name in the Irish three and the one fourth per cent as per Certificate bearing date the fourth day of August one thousand eight hundred and forty five also a sum of two thousand pounds lodged in the English funds in my name and that of Francis Broderips Esquire of New Square Lincolns Inn London said last sum to secure the payment of a certain annuity granted to my sisters Bridget and Dorothea of thirty pounds each under the will of my brother Thomas Barry deceased which will is dated at Ipswich in England the twenty fourth day of April one thousand eight hundred and forty one and inasmuch as I am also possessed of certain property in the farm of Rathcreagh where I now reside consisting of corn ... cows horses etc. Secondly I direct that my remains shall be interred in the family vault at Killrathron and that my remains may be conveyed thereto by my Men and that my funeral may be conducted in a respectable manner as my Executors may deem fit but without any outer shew or pomp which I have invariably depreciated Thirdly I order that all rents and taxes etc. which may appear due of me at the time of my death shall be paid by my Executors with all convenient speed I bequeath a sum of one thousand pounds to be vested in government stocks to secure the payment of an annuity of thirty pounds to my sister Dora which annuity she is to have during her life but with the principal she is to have no control over I leave to Ellen O'Brien the second daughter of my sister Bridget O'Brien the sum of one hundred and fifty Pounds I leave to Mary O'Brien the youngest daughter of my sister Mary the sum of one hundred and fifty Pounds I leave to Bridget Harnett of Bally monough near New Castle eldest daughter of my sister Mary the sum of one hundred and fifty Pounds I leave to Maria Connell of Bridge Street New Castle Wife of Florence O'Connell and daughter of my sister Peggy Walker the sum of one hundred and fifty Pounds to the grandchildren of my sister Mary Sullivan deceased I leave to Richard Sullivan son to James Sullivan of the Sixty seventh Regiment of foot the sum of Seventy five pounds To Sally Sullivn daughter of the said James Sullivan of the Sixty seventh Regiment of foot aforesaid the sum of Seventy five pounds I leave to Bridget Keely of Ardagh daughter of my sister Mary Sullivan deceased the sum of twenty pounds I leave to Mary Kirby of Ardagh daughter of Denis Kirby of Ardagh and granddaughter of my sister Mary aforesaid deceased the sum of twenty pounds To the children of my late nephew James Barry of the City of Limerick deceased I bequeath the following sums videlicet I leave to Richard Barry the eldest son of the said James Barry deceased the sum of one hundred pounds I leave to James Barry the second son of the said James Barry the sum of one hundred pounds I leave to Thomas Barry the second son of the said James Barry the sum of one hundred pounds I leave to Mary Barry the only daughter of the said James Barry the sum of one hundred pounds and to John Barry the youngest son of the said James Barry I leave the sum of one hundred pounds these sums amounting together to the sum of five hundred pounds to be vested in government stock by my Executors until these children attain their respective ages of twenty one years and in case of any of these children which I hope may not be the case should unfortunately become a reckless character or a bad member of society then it is my wish that he be cut off from any part of participating in my bequests and that the sum or sums of money allotted for him or them be divided share and share alike amongst the other members of the family of my said nephew before described To the children of my brother James Barry deceased I bequeath the following sums videlicet I leave to my niece Ellen Barry now residing with me the sum of five hundred pounds with my gold watch and appendage as also half my plate and pictures I leave to Margaret O'Brien wife of Stafford O'Brien of Ardcarney Cottage in the County of Clare the sum of two hundred and fifty pounds with half my plate and pictures To my Cousin Richard Meara of Kilbrethern I leave the sum of twenty pounds I leave to my faithful servant Bryan Ahern the sum of five pounds I leave to my faithful labourer Timothy Donovan the sum of five pounds to my other labourer Patt Conway I leave the sum of five pounds To my natural son Philip Barry aged seven years on the thirtieth day of May next I leave one thousand pounds to be vested in three and the one fourth per cent in the name of my executors In trust for the said Philip Barry until he attains the age of twenty one years the interest arising on same to be applied to defray the expences of his schooling clothing etc. and in the event of this interest not being sufficient to defray the expences of his schooling etc, then I authorize and empower my Executors to draw a same from the capital aforesaid as will enable them to pay for all expences attending the schooling clothing and fitting of the said Philip Barry this bequest I make on the presumption that the said Philip Barry will grow up in the fear and love of God and become a respectable member of Society if he does not my will is that instead of the one thousand pounds heretofore bequeathed to him he gets but one hundred pounds to bind him to some trade or calling as my Executors shall deem fit It is also my wish that if the said Philip Barry should list or leave the Country or go to America to his mother that he shall have no participation in my bequeast save only as far as one hundred pounds which my Executors are authorized to pay him as stated above to bind him to some trade or calling I leave to the son of my niece Bridget Harnett the sum of one hundred pounds sterling for his schooling etc. I leave to my nephew Patrick Barry O'Brien of Kilrush on the County of Clare All the rest residue and remainder of my Property of every kind whatsoever which I may die possessed of or be entitled to including the sum of two thousand pounds lodges in the English funds aforesaid and the sum of one thousand pounds directed by this will to be lodged in government Irish stock to Provide an annuity for my sister Dora during her life and any other sum and sums which I may possess or be entitled to at my death which will not be paid to my other legatees under this will And I do constitute and appoint him the said Patrick Barry O'Brien with my nephew in law Mister Florence O'Connell of New Castle in the County of Limerick as my Executors to carry out the purport of this my will which I hope they will do with the utmost punctuality and honor I also wish that the poor legatees herein mentioned be first paid and should it appear that any arrear of rent should be due to me of my labourers at the hour of my death I hereby order that any sum so appearing due shall be remitted I will and desire that my clothes may be given to the poorer members of my family as my sister Dora and my Executors m\y think fit That there shall be no crying at my funeral and that my funeral shall be attended by the Reverend Mister McDonnell and his Curate the Reverend Maurice Ahern of Castle The Reverend Daniel Leaky and the Reverend Michael McMahon and that each shall accept the sum of one pound sterling and that the Reverend Mister Curtis the Rector of Rathronan shall also be invited to attend my funeral I will and desire that the sum of five hundred pounds bequeathed to my niece Ellen Barry be lodged in the funds and that the interest arising from it shall be paid regularly and that this sum shall be handed over on her marriage which marriage shall be with the concurrence of my Executors but in case she should die and not get married then my will is that the said sum of five hundred pounds so bequeathed to her as aforesaid shall be divided share and share alike amongst my nephews and nieces to wit Peggy O'Brien of Rod... and Mary O'Brien of Tiermore Maria O'Connell of New Castle and Patrick Barry O'Brien of Kilrush in the County of Clare aforesaid and Mistress Bridget Harnett aforesaid and as the farm at Rathcreagh gets out of lease on my demise it is my will that my nephew Patrick Barry O'Brien aforesaid do go to the County of Cork and treat if possible with the landlord for a renewal of the said lease as I should like to have a member of my family always in possession of said farm in getting a new lease then I should wish that my sister Dora should stay in Rathcreagh during her life and that she and my nephew aforesaid should make such arrangements among themselves as may be gratifying to them.........I will a sum of five pounds each to my Executors to purchase mourning rings as a testimony of my regard for them I leave to the said Philip my bed and bedding and all my house linen providing he conducts himself as aforesaid to the satisfaction of my Executors In witness whereof I
