Archives Kew England Written: February 8, 1831 Recorded: April 11, 2019 I James McLeland of Annaverna in the County of Louth lately one of the Barons of His Majestys Court of Exchequer in Ireland do make and publish this my last Will and Testament in manner and form following I hereby devise the sum of five hundred pounds to my dearly beloved Wife Charlotte McLeland to be paid to her immediately after my decease and I do also hereby devise to my said Wife all my household furniture of whatever description also all my wines plate plated ware linen china carriages horses farming stock and implements of and all my books I do devise hereby the lands of Aughnaverney otherwise Annaverna and of Drimna Carragh in the County of Louth which I hold by several leases under Sir Harry Goodericke Bart and Christr Moore Esqr and all Estate and Interest in the Lands to Richard Pennefather one of the Barons of the Estate and Interest in Ireland and James Trail Hall one of His Majestys Counsel learned in the law and the survivor of them and the heirs of such survivor to the uses and upon the trusts following that is to say to the use of my said Wife Charlotte McClelland during the term of her natural life and from and after her decease to the use and behoof of such person or persons their heirs and assigns and under such limitations as my said Wife shall by Deed or by her last Will and Testament limit and appoint and in failure of such appointment to the use and behoof of Acheson Thompson of the eighty seventh regiment of foot nephew of my said Wife and son of the late Quinton Thompson his heirs and assigns And whereas I have effected two policies of Insurance on my life one with the equitable Insurance Company of London for the sum of five thousand pounds and the other with the Atlas Insurance Company for the like sum of five thousand pounds Now I do hereby devise the said two policies of Insurance and all monies and benefits arising therefrom to the said Baron Pennefather and James Trail Hall their executors and administrators upon the trusts and for the uses following that is to say Upon trust as soon after my decease as conveniently may be to receive the two sums of five thousand pounds each all other monies payable on account of said Policies of Insurance or either of them and further on the receipt thereof to lay out and invest the same in the purchase of Government stock or on real security with the consent of my Executors hereinafter named and it is my will and pleasure that my said trustees shall stand possessed of said Government stock so purchased with the proceeds of said Policies of Insurance and the real securities on which said money may be lent as aforesaid upon the same trusts and to and for the same uses as are hereinafter expressed and declared of and concerning the residuary trust fund hereinafter particularly mentioned devised and bequeathed I hereby devise to my said trustees Baron Pennefather and James Trail Hall their heirs and assigns my house in Mountjoy Square which I purchased from the Archbishops of Tuam Upon trust to sell and dispose of the same as soon as they conveniently can after my decease and forthwith on the receipt of the money arising from the sale of my said house to lay out and invest the same in the purchase of Government stock and upon this further trust that they my said trustees their executors and administrators shall stand possessed of the Government stock so purchased with the proceeds of sale of my said house upon the same trusts and to and for the same uses as are hereinafter limited and declared of and concerning the residuary fund hereinafter particularly mentioned devised and bequeathed And as to all the Rest Residue and Remainder of my real and personal Estate of what nature or kind soever And as to all the Government stock so to be purchased with the proceeds of same Policies of Insurance or the real securities on which such money may be lent out by my said trustees as aforesaid and as to the Government stock so to be purchased with the proceeds of sale of my said house in Dublin I do hereby devise and bequeath the same to the same to the said Baron Pennefather and James Trail Hall their heirs executors and administrators to the uses and upon the trusts following that is to say upon trust in the first place to pay thereout one annuity or yearly sum of one hundred pounds to my Sister Harriott McClelland during the term of her natural life by equal half yearly payments and subject to the said annuity Upon further trust to pay one annuity or yearly sum of Sixty pounds to Mrs Hester McClelland the widow of my late brother Hugh McClelland by equal half yearly payments during the term of her natural life and if on the decease of the said Hester McClelland her daughter Hessey Giffney should be then living then upon this further trust to pay one annuity or yearly sum of Forty pounds to the said Hessey Giffney by equal half yearly payments during the term of her natural life the said annuity to be paid to her the said Hessey Giffney for her sole and separate use free from the control or interference of her husband and subject to the said annuities Upon this further trust to pay over such sum of money not exceeding the sum of three thousand pounds to such person or persons as my said Wife Charlotte McClelland shall by any Deed under her hand and seal direct and appoint to be raised out of the said residuary fund as and for a marriage portion and provision for her niece Charlotte Thompson the daughter of the said Quinton Thompson in case my said Wife shall during her life choose to add to the provision and fortune to which the said Charlotte Thompson is entitled in her own right and subject to the said annuities and said powers of charging for said Marriage portion then upon the further trust as to the said residuary fund to the use of my said Wife Charlotte McClelland during the term of her natural life and from and after the decease of my said Wife to the use and behoof of such person or persons and under such limitations as my said Wife shall by any deed or deeds or by her last Will and Testament limit and appoint and in failure of such appointment then upon trust to sell and dispose of the whole of the residue of said property so devised by this residuary clause or made subject to the trusts thereof and to convert the same into money and to divide and pay over the same in the following manner that is to say one third part thereof to the said Charlotte Thompson the niece of my said Wife and the remaining two thirds thereof to the said Achison Thompson the nephew of my said Wife And I do hereby nominate and appoint Maxwell Blacker Esq one of His Majestys Counsel learned in the law and my said Wife Charlotte McClelland Executors of this my Will In Witness whereof I have hereuto set my hand and seal this eighth day of ffebruary in the year of our Lord one thousand eight
