MAY 17, 1859. WILL PROBATE MICHAEL MAUNSEL

Court of Probate--Yesterday.

Judge KEATINGE sat yesterday in the Probate Court for the 
trial of will cases.

In this case a suite was instituted to revoke probate to a 
paper writing relied on by the defendant as the last will 
and testament of one Michael MAUNSEL, deceased. The 
deceased, who had been a farmer residing in the King's 
County, left property to the amount of £700. By the alleged 
will he bequeathed to his wife £80 and some portions of his 
far, The remainder he divided amongst his nephews, with the 
exception of some small legacies. He appointed the defendant 
in the present case as his administrator. The Plaintiff, one 
of the nephews of the testator, disputed the validity of the 
execution of the document in question. The defendant 
produced some witnesses in support of his case. They deposed 
that the attesting witnesses signed the document in another 
room from the one in which the deceased was lying, but that 
he could see them from his room signing the document. The 
plaintiff produced evidence to show that one of the 
witnesses, who was stated to have attested the instrument, 
was absent when the deceased signed it.

The jury found for the defendant, and established the 
validity of the will.
