Thos Armstrong1207 1 9 121 5 0 By lease dated 1st January, 1714, made by Kingsmill Pennefather, of Newpark, in the County of Tipperary, Esq., and Elizabeth Pennefather, his wife, to Thomas Armstrong, for three lives, with covenant for perpetual renewal on payment of £62 13s 6d. of the Irish currency, as a renewal fine, rent reserved by said lease is £125 7s 0d. of the then Irish currency, payable half-yearly, together with four fat wethers, to be delivered at Candlemas, in every year, at Newpark, aforesaid. The rent here stated £121 5s 0d present currency, included £5 10s 10½d. being as equivalent for said accates. By said lease, the premises demised are stated to contain in the whole 691 Acres, but by a Survey made thereof in the year 1845, based on the Ordnance Survey they appear to contain, including Bog, 1207 Acres 1 Rood, 9 Perches statute measure, equivalent to 745 Acres 1 Rood and 14 Perches plantation measure. By said lease, liberty is reserved to the said Kingsmill Pennefather, and his servants to hunt, fowl, fish, hawk and shoot on said premises, in fit and proper seasons, and places for same. And all mines, minerals, and coals are reserved to lessors, with liberty to said lessors and their heirs to cut turf, as they think fit, in some convenient place of the Bog of Mealiffe, where turf is usually cut, together also with free ingress, egress and regress for said lessors, their heirs and assigns allowing reasonable amends and satisfaction to said lessee for the waste; spoil and damage that should be committed on the grass, corn, or soil of the premises by means thereof. The last renewal of said lease bears date the 20th day of February, 1849, and was executed by the said Mathew Pennefather to William Armstrong, then of Mealiffe, since deceased, for three lives, two of which are still living, viz: the Rev. Alfred Thomas Armstrong, now of Cullen Glebe, county of Limerick, and George Armstrong, of Chaffpoole, in the county of Sligo, Esquire. A renewal fine of £62 13s 6d. became due on the death of the Rev. Marcus Armstrong, late of Moylough Glebe, in the county of Galway, one of the lives named in the last renewal, who died on or about 28th November, 1850, and said fine is still unpaid. The Lands of Mealiffe are held in Fee, subject to payment of the yearly Quit Rent of £7 7s 9d., which, under the above-mentioned lease is payable by the tenant, the lessee in said lease having covenanted “to pay yearly rent and accates, and to pay, bear, and discharge, over and above said rents, all taxes and charges, ordinary or extraordinary, which then were, or thereafter should be imposed on the stock, or premises, or any part thereof, by any Act of Parliament, or otherwise, as also Quit Rent and Crown Rent, except all taxes which should be laid on the said reserved rents, which were to be paid by the lessors, and their heirs.” The tenant is primarily liable to payment of the Tithe Rentcharge. Those Lands are situated within about 6 miles of the town of Thurles, 4 miles from the Goold’s Cross station of the Great Southern and Western Railway, and about 9 miles from the city of Cashel. Avary Stinson, then aged about nineteen years, second son of Alexander Stinson, then of the City of Cashel, and Patrick Mahony, son of Laurence Mahony, of said city of Cashel, shopkeeper, then aged about twelve years. By this lease the lessors demised the Lands of Erry and Bawnfawn, also that part of said Lands of Erry formerly in the possession of the late Edmond Scully and his undertenants, containing about 30 acres; also the lands of Carhue, otherwise Carewreech, as formerly demised to Samuel Alleyn, except 35 acres, 2 roods of said lands of Carhue, then in the possession of William Pennefather, and also excepting 14 acres, 2 roods and 15 perches of the turf bank and spreading ground, part of the Commonage of the said lands of Erry, then in possession of said Richard Pennefather, intended for cutting and saving turf for his own use; all of which premises are set out in a map, or survey, endorsed on said lease, and are demised together with all buildings, moors, marshes, bogs & & with full and free liberty for the said Avary Jordan, his heirs, undertenants, and assigns, to cut and save turf for sale in and upon the said demised premises, or any part thereof. By said survey on said lease, the number of acres contained in said Lands of Erry is stated to be 361 and 5 acres, 3 roods and 15 perches, plantation measure: and by a survey thereof, since made, based on the Ordnance Survey, the number of acres appears to be 546 acres, 1 rood, and 4 perches, plantation measure, including bog and commonage. By said Survey on said lease, the number of acres contained in said Lands of Carhue, is stated to be 77 acres, 2 roods, 20 perches, plantation measure; and by said Survey, since made, they appear to be 77 acres, 1 rood, 21 perches. This lease contains a covenant on the part of the lessee to pay tithes of said holding, notwithstanding the Act of 4th Geo IV. C.99. Said lease also contains a covenant on part of lessee to preserve and maintain the possession and bounds of said demised premises from all encroachments, with liberty to said lessors to perambulate and view said bounds, as therein mentioned. The rent here state includes the tithe rentcharge. 2 Ditto Reps. of William Loney (now W Loney) 126 1 33 5 13 4 By lease dated November 5th, 1782, from Richard Pennefather to William Loney, for three lives, two of which are still living, viz. Thomas Loney and Edward Loney sons of lessee. The premises are by said lease described as that part of the bod of Erry formerly held by Walter Strong, of Coolcaugh. The number of acres is not stated; but by said Survey they appear to be 78 acres and 11 perches plantation measure, of Bog pasture and arable land. By an endorsement on siad lease , it appears it was agreed before the execution thereof that the said Richard Pennefather and his tenants should have free leave to cut and draw turf of said bog during the term of said lease. The rent here stated includes tithe rentcharge. Part of bog of Erry Reserved by lessors by Lease Holding No 1. On hands 23 2 2 - - - This is a turf bank and spreading ground part of the commonage of said lands of Erry, by said lease of holding No 1, reserved to the lessor in said lease intended for cutting and saving turf for his own us.By a survey made of said land sof Erry in the year 1845, based on the Ordnance Survey, they appear to contain, including bog and commonage,1034 acres, 3 roods and 38 perches, statute measure. They are situate within about 3 miles of the City of Cashel, 5 of the Gooldscross station of the Great southern and Western Railway, and 8 of the Town of Thurles. By said fee-farm grant liberty is reserved to the lessor and his heirs, and their servants and attendants, for the time being, along with him or them, of hunting, hawking, fishing and fowling, in and upon the said premises in fit and proper seasons and places for the same. And also there was excepted out of the said grant, all hawks, eyries of hawks, escheats, felons and fugitives, goods, waifs, strays, and deodands, which then were, or thereafter should be had or found in or upon the said premises; together with all advowsons, presentations of churches, Seneschalships, profits of Courts Leet and Courts Baron, and all other royalties and franchises whatsoever unto the said premises, or any part thereof belonging or appertaining; together also with free ingress, egress and regress for him the said Duke, his heirs and assigns, and for all and every other person and persons to whom the rent thereby reserved should for the time being for ever thereafter belong, and for his or their servants, by his or their command, to take and carry away, respectively, all the premises excepted. The rent reserved by said fee-farm grant, including an equivalent for accates and receiver’s fees, is only £13 17s 3d. late currency- equivalent to £12 15s 11d. present currency- although the sum of £16 6s 11d (above stated) has been paid yearly for some years past to the representative of the grantor by the said Mathew Pennefather, the fees for accates have been increased. By said fee-farm grant the said rent is reserved, payable of the 25th March and 29th September in each year, clear of, and from, and without deduction for any taxes, assessments, subsidies, or impositions by act of parliament, or otherwise, except Quit Rent and Crown Rent, Chief Rent, and such impositions or taxes as might be laid or imposed on the said yearly rent. The said fee-farm grant contains a covenant on the part of the said lessee, that he the said Kingsmill Pennefather, his heirs and assigns, or his or their tenants, living and dwelling on the premises, should and would from time to time, and at all times for ever thereafter, appear and do suit and service at the Court Leet and Court Baron of the said Duke of Ormonde, and his heirs, to be held at the Manor of Holycross, when and as often as duly summoned thereto. The acreage stated in the above Rental is taken from the leases, except in the case of yearly tenancies, and by a survey made of said lands in the year 1845, based on the Ordnance Survey, they appear to contain 243 acres and 6 perches statute measure.
