Will: Bagwell, Benjamin 1838 *********************************************** Ireland Genealogy Projects Archives Tipperary Index Copyright ************************************************ File contributed by: Rosalind Dunning ros.dunning@outlook.com November 29, 2019 BAGWELL, BENJAMIN 1838 Source: National Archives London Written: December 1, 1831 Recorded: April 13, 1833 The last Will and Testament of Benjamin Bagwell late of the Town of Clonmell County of Tipperary Ireland I hereby revoke all former Wills heretofore made by me and declare this to be my last Will and Testament being in sound mind and judgment And whereas I am possessed of the following sums of money goods and property of various kinds which I leave and bequeath in the following manner that is to say the late Major Bigor Armstrong Stonby of Greyfort in the County of Tipperary jointly with his son Robert Stoney owes me the Balance of a Bond of four hundred pounds Sterlg which Balance at present Amounts to about three hundred and sixty pounds Sterg together with interest due thereon I leave and bequeath the said balance of said Bond and Interest due be it more or less to my Wife Anne Bagwell (late Anne Carew of Clonmell whom I married in the year 1826 privately and unknown to any person save and except the Clergyman who performed the Ceremony and one witness) And Whereas the late Thos Prendergast late of the Tipperary Militia owed me at the time of his decease the Balance of a Bond and Interest thereon amounting to one hundred and fifty pounds or thereabouts I leave 7 bequeath the said Balance & Interest due by the late Major Thos Prendergast be it more or less to my said Wife Anne And whereas I am possessed of twenty shares in the Provincial Bank of Ireland I leave and bequeath the said twenty shares to my said Wife Anne And whereas I am possessed of some Plate Plates Articles Glass China etc. etc. now lying in the Bank of Clonmel and at Marlfield I leave and bequeath the same to my said Wife Anne and I likewise direct that my said Wife Anne pays all my just debts and funeral expences which I desire may be conducted with as little expence as possible and that the Debts due me by Bond or otherwise be collected without the least delay and that all the sums mentioned as above be put together and placed in Government Security for the support of my said Wife and our two children Mary Anne and Margaret Catherine I hereby appoint my said Wife Anne my sole Executrix and Administratrix to this my last Will and Testament to which I affix my name and seal this 1st Day of December in the year of our Lord 1831 thirty one Benjamin Bagwell I desire that at the decease of any of the three persons to whom I leave my Property as above Viz my Wife and two Children that the property be divided between the remaining two and that if either or both my Daughters should marry with the consent of their Mother and not otherwise she or they get their portion of one third of the Property Given under my hand this 1st day of Dec 1831 one (Appearance by Stephen Pepper of Clonmell Gentleman and Patrick Ryan of Clonmell Shopkeeper as to manner and character of writing of deceased 7 March 1833) Proved at London with a Codicil 13 April 1833 PCC Prob11/1814
