the Name of God Amen I Michael Bourke of Glanacuna Lodge in the County of Tipperary Esquire being of sound and disposing mind and memory do make this my last Will and Testament in writing hereby revoking any Will or Wills by me heretofore made first my will and desire is that my just and lawful debts be paid with all convenient speed and for this purpose I leave and bequeath to my Executrix and Executors hereinafter named the yearly sum of fifty Pounds out of the lands of Glanacuna to be by them applied to the discharge of my said debts until the same shall be fully discharged and paid and as to my property I dispose of it as follows I leave and bequeath unto my beloved Wife Elizabeth Bourke otherwise Fennell all my right title and interest of in and to the lands of Darrogh in the County of Limerick for and during her natural life I leave and bequeath unto my said Wife in trust for my Daughter Matilda Bourke one annuity or yearly rent charge of one hundred pounds St I to arise from and become payable half yearly out of the lands of Glanacuna aforesaid for and during the life of my said daughter in case she shall die unmarried but in case she shall have been married with the consent and approbation of my said Wife and of my Executors hereinafter named and that she shall have issue of such marriage living at the time of her death that she shall have it in her power to bequeath said annuity to such issue in such manner as she shall think proper for and during the lease of said lands of Glanacuna aforesaid and in case there shall be no issue of such marriage and that the husband of my said daughter shall survive her that he shall be entitled to the benefit of the said annuity for and during his natural life with reversion thereof to my son Edmond Bourke hereinafter named his heirs and assigns I leave and bequeath unto my Son Michael Bourke now Lieutenant in His Majestys Regiment of foot one annuity or yearly rent charge of one hundred pounds St I to arise from and become payable out of the lands of Glanacuna for and during his life and in case he shall have been married and shall have issue of such marriage living at the time of his death that he shall have power to bequeath such annuity by his Will to such issue in such manner as he shall think proper for such term as I hold said lands of Glanacuna and in case of no issue of such marriage and that the Wife of my said Son Michael shall be entitled to the benefit of the said annuity for and during her natural life with reversion thereof to my said son Edmond Bourke his heirs and assigns I leave and bequeath to my Brother in law Edmond Fennell one annuity or yearly rent charge out of the lands of Glancanuna aforesaid of twelve pounds St I during his natural life Whereas I did on the marriage of my daughter Elizabeth with her Husband Captain George Newell secure to him by marriage settlement one annuity of fifty pounds St I during the life of his said Wife and whereas it is my wish and intention to appropriate the amount of the said annuity (after the death of my said daughter Elizabeth)to the use and benefit of the present Children of my said daughter Elizabeth with the said Captain Newell Now my will and desire is and I do accordingly bequeath to my Executors hereinafter named one annuity or yearly rent charge of fifty pounds St I to commence from and immediately after the death of my said daughter Elizabeth Newell I trust for and to be applied in the purchase of Government stock to the sole use and benefit of Maria Newell the second daughter of the said Captain Newell now living with me about nine years old until she shall have attained the age of twenty one years or until she shall be married with the consent and approbation of the said Captain Newell and said annuity to enure to my said Granddaughter Maria Newell for and during her natural life and after her death the said annuity to devolve to and become payable to my Granddaughter Eliza Newell the eldest daughter of the said Captain Newell for and during the natural life of my said last mentioned Granddaughter I leave and bequeath unto my Son in law The Reverend James Corcoran of Mount Usher in the County of Wicklow one annuity or yearly rent charge of fifty pounds St I to be paid him in lieu of the balance of the marriage portion of his Wife which remained due to him to be paid to him by half yearly payments until such time as he shall (under said rent charge) have received a sum of four hundred pounds St I but it is my intention that any money that shall or may be paid to him by me subsequent to the day of the date hereof shall be taken and considered as part of the said sum of four hundred pounds and be accordingly deducted therefrom I also leave and bequeath unto my Granddaughter Betsy Ann Corcoran Eldest daughter of the said James Corcoran to James Michael Corcoran second son of the said James Corcoran the sum of fifty pounds St I each as a testimony of the love I bear them said sums to be paid to the said father of said Children the two successive years after the payment of the above legacy to him And as to any money or property which I may be entitled to under the Will of my Brother in law the late Captain Baker Fennell I direct that the same when received shall be divided into two equal parts one moiety of which is to become the sole property of my beloved Wife in case she shall be living at the time the same shall be recovered and that the same shall be disposed of by my said Wife to her Children in this Will in such proportions and shares as by her Will she shall think proper to direct and the other moiety to become the property of my Sons Edmond and Michael share and share alike or the property of the survivor of them and in case my said Wife shall not be living at the time the same shall or may be received then my will is that the money which shall or may be received after the death of my said Wife in consequence of my claim or title to the property of the said Baker Fennell that the sum of two hundred pounds be paid to the present Children of the said James Corcoran and a further sum of two hundred pounds to the present Children of the said George Newell and that the remainder of such money as shall be received be divided share and share alike between my said Sons Edmond and Michael and my said Daughter Matilda Bourke and the survivors and survivor of them and whereas there is a sum of seven hundred pounds St I due to me from Hifferman Considine Esquire now my will is that as soon as the same shall be received the sum of two hundred pounds thereof shall be paid to the before mentioned James Corcoran in part payment of the bequest of the four hundred pounds to him which is directed to be paid by fifty pounds a year and that the residue of said sum of seven hundred pounds shall become the property of my beloved Wife to be by her disposed of to such of my Children as she shall think fit I leave and bequeath to my eldest Son Edmund Bourke all my right title and interest of and to the farms and lands of Emly and Glanancuna both in the County of Tipperary (subject to the bequests before mentioned) and Darrogh in the County of Limerick (after the death of my said Wife) and I appoint my said Eldest Son Edmund Bourke Residuary Legatee of this my last Will And lastly I nominate constitute and appoint my said beloved Wife Executrix and The Right Honorable the Earl of Kingston and Roger Sheehy Bourke of Spring Vale Gentleman Executors I direct that none of my said Children shall contract matrimony without the consent and approbation of my said Wife and Executors In Witness whereof I have hereunto set my hand and seal this first day of July one thousand eight hundred and
