Will: Burke Or Bourke, Tobias Otherwise Timothy 1811 *********************************************** Ireland Genealogy Projects Archives Tipperary Index Copyright ************************************************ File contributed by: Rosalind Dunning ros.dunning@outlook.com November 4, 2018, 9:35 am BURKE OR BOURKE, TOBIAS OTHERWISE TIMOTHY NOVEMBER 13, 1811 Source: National Archives Kew England Written: November 13, 1811 Recorded: November 4, 2018 In the Name of God Amen I Tobias Burke belonging to HM Ship Minder in the Carpenters Crew No on the Ships Books 380 but at present a patient in HM Hospital Ship Willhemina being in indifferent health but of sound and disposing mind and memory and considering the perils and dangers of the Seas and other uncertainties of this transitory life do for avoiding controversies after my decease make publish and declare this my last Will and Testament in manner following that is to say ffirst I recommend my Soul to God that gave it and my Body I commit to the Earth or Sea as it shall please God to order and as for and concerning all my worldly Estate I give bequeath and dispose thereof as followeth that is to say all my pay wages (prize money excepted of which I dispose of as undermentioned) and all and Singular other Sum and Sums of Money Lands Tenements Goods Chattels and Estate whatsoever as shall be any ways due owing or belonging to me at the time of my decease particularly for HM Ships Cornwallis Russel Minder and Sloop Hester I do give devise and bequeath the same unto my Mother Catherine Burke relict of my Father residing in the Parish of Greathurst near Clonmel in the County of Tipperary Ireland if alive but in the event of her decease to my Brother John Burke belonging to H Majesty's 59th Regiment of Foot now serving in and in case of the death of both Mother and Brother then I do in like manner give devise and bequeath the pay or wages above mentioned to my Uncle James Daniell farmer at Rakirra near Greathurst above mentioned but it is clearly to be understood that if my Mother survives she alone is to succeed to all my pay or wages and as for and concerning my Prize Money for the different Ships above mentioned I do give devise and bequeath the Sum of Twenty Pounds thereof to my Shipmate Patrick Doyle ordinary Seaman of His M Ship Minder and now a Patient in His Majesty's said Hospital Ship in consideration of the care and attention he has bestowed upon me in my Illness and our long Friendship and should all my Prize Money amount to more than £20 I hereby desire the overplus to be added to my wages for the benefit of my Mother Brother or Uncle given to the Survivor of these three I do in like manner give devise and bequeath to my said Shipmate Patrick Doyle all the wearing apparel and personal property found in my possession at the time of my death and to my Shipmate William Barry of the Carpenters Crew now living on board His Majesty's Ship Minder I leave all my Tools belonging to my Trade as Carpenter which now are on board HM Ship Minder for his sole use and benefit and I do hereby Nominate and Appoint J W Bedingfield Esq.
