Will: Maher, Timothy October 24, 1805 *********************************************** Ireland Genealogy Projects Archives Tipperary Index Copyright ************************************************ File contributed by: Rosalind Dunning ros.dunning@outlook.com April 21, 2019, 10:10 am MAHER, TIMOTHY OCTOBER 24, 1805 Source: National Archives Kew England Written: October 24, 1805 Recorded: April 21, 2019 In the Name of God Amen I Timothy Maher Surgeon on His Majestys Ship Weymouth No on Ships Books 258 being in sound disposing Mind and Memory although very weak in body and knowing the uncertainty of this Life with a wish to avoid all Controversies after my decease relative to the disposal of my Property be it either Hereditary or Personal I have made and do hereby make and declare this my last Will and Testament First upon mature Consideration I am fully satisfied that my dearly beloved Brother Francis Maher is perfectly independent of any bequest I have to make and that he will pleased with the manner in which I dispose of my property that my dearly beloved Sister Mary McGrath Wife of Daniel McGrath Merchant of the Isle of Trinidad And also that my dearly beloved Sister Catherine Burke Wife of John Burke Merchant in the Town of Nenagh in the County of Tipperary have nothing whatsoever to apprehend of being deprived of the Comforts of Life and Independence Should they be reduced to a State of Widowhood I do therefore preclude them the said Francis Maher Mary McGrath and Catherine Burke from receiving any Money or Monies or any other Benefit whatsoever that may arise from the whole or any part of my Property at my Decease be it either Hereditary or Personal but as I am not certain whether my dearly beloved Sister Ellen Tuohey enjoys the same Comforts not knowing the Circumstances of her Husband and I admit her to have full Share in every part of my Property in Conjunction with my ever dearest Mother Ellen Maher Widow and my dearly beloved Sister Amelia Maher All of the Town of Nenagh aforesaid I therefore devise bequeath and desire that all my wages pay Prize Money Compensation Money all my Property in any way and every way arising owing due or may be due owing or belonging unto me and all Estate or Estates whatsoever that may be coming to me either from the Commissioners of his Majestys Navy or any other Person or Persons be given and paid unto the said Ellen Maher Widow Ellen Tuohey and Amelia Maher equally in Conjunction To be by them To be by them put in the ffunds for their conjunctive Benefit and advantage strongly recommending them not to encroach on the Capital until the different Leases of Farms now by my dearest Mother and Sisters have expired but with the Interest of the said funded Property purchasing more capital Stock by which means at the expiration of the said Leases Item second It is my further desire and will that at the demise of any one of the said Ellen Maher Ellen Tuohey and Amelia Maher the Survivors or Survivor do Possess the Intire of the Properties I do die possessed of or the Capital arising therefrom Item Third I do humbly request that my dear Brother in Law John Burke John O Meara(?)and Cornelius OBrian will be Pleased to see executed this my last Will and Testament and be the protectors of the Orphans And I hereby constitute and appoint them the said John Burke John O Meara(?)and Cornelius OBrien my Executors Administrators and Assigns And if they or any two of them thought it would be adviseable for the Advantage of the Family to transfer the said Principal Stock from England to Ireland they have my full Permission so to do And I do hereby declare this to be my last Will and Testament hereby revoking all other Wills or Deeds of Gifts at any time or times heretofore made by me In Witness whereof I have hereunto set my Hand and Seal on board His Majestys Ship Weymouth at Sea this twenty fourth Day of October in the Year of our Lord one thousand eight hundred and five The Mark X of Timothy Maher Witness J Draper Captain of HMS Weymouth _ Ja: Cunningham Late Surgeon of the Sceptre _ Thomas Godfrey Purser of HM Ship Weymouth (Declaration by Ja: Cunningham that Testator totally unable to affix his usual signature) Proved at London by the Oath of John Burke 21 April 1806 Power reserved to other Executors PCC Prob11/1441
