I Thomas Binns of the City of Waterford being at present 
favoured with soundness of mind and pretty good bodily 
health but considering at the same time the great 
uncertainty of life and wishing to have matters relative to 
my worldly concerns settled before the period of my being 
called hence may arrive knowing that at such a time it is 
often sufficient to have to struggle with the pains of an 
afflicted body under those considerations I feel best 
satisfied to express my mind as to the disposal of my 
Effects after my decease in this my following Will and 
Testament viz. As soon as conveniently may be after my 
Internment I would wish to have my funeral Expenses and 
whatever Debts I may leave behind me fully paid off and 
discharged The Profit rent arising from my Holdings on 
Thomas Hill in the Coty amounting at present to fifty six 
pounds seventeen shillings and sixpence yearly I bequeath to 
my two Sons Thomas and John jointly each half share and 
share alike The profit rent arising from my C...... at 
Newtown in the Neighbourhood of this City amounting to 
Eighteen pounds one shilling and three half pence yearly I 
bequeath to my Son William The profit Rent arising from my 
house in Queen Street in this City I bequeath to my Son 
Charles amounting to Seventeen pounds one Shilling and 
threepence yearly My one thirty second share or part of the 
Brig or vessel caller the Constantia I bequeath to my son 
Charles My one sixteenth share of the Schooner or Vessel 
called the Erin I bequeath to my Son William The Money which 
I may have behind me however it may be situated whether 
vested in any of the Public Securities in Bills or placed in 
the hands of any Individuals at Interest I would have 
disposed of in the following manner viz. twelve hundred 
pounds of said Money I bequeath to my Daughter Elizabeth One 
thousand pounds of said Money I bequeath to my two Brothers 
William and Joseph In trust for my Daughter Rachel said 
Money to be placed by them in such manner as they may judge 
most suitable for her benefit until she arrive to the age of 
twenty one years unless before she attain that age she 
should marry in the Society of friends agreeably to the good 
order and amongst them and with the Approbation and consent 
of my said two Brothers In Which cased my Will is that the 
said thousand pounds with whatever Interest may have 
accumulated on it may be paid her by my two Brothers as soon 
as conveniently may be after her said Marriage during her 
Minority and whilst she remains single I wish such 
proportion of the Interest arising from the said thousand 
pounds should be paid her annually as they may think her 
situation shall require The remaining surplus of my named 
property after what I have left to my two Daughters I 
bequeath to my four Sons jointly to be divided among them 
equally share and share alike The Property which I have 
bequeathed to my Son Charles I should wish my two Brothers 
to take charge of as trustees for his use until he attain 
the age of twenty one years and to appropriate such part of 
the Produce thereof to defray his necessary expences of 
Education or Clothing or Apprentice fee as they may deem 
suitable during his Minority And my wish is that he should 
be placed Should the family continue to reside in Ireland at 
friends Munster Provincial School at Newtown in case of the 
removal of the family to England at either of the Public 
Institutions of friends there that my said two brothers may 
think most eligible for him and continue there until a 
suitable place may be procured for placing him out 
Apprentice The two Debentures or shares which I have in the 
Bridge of Waterford I bequeath to my two Daughters one share 
to each and the produce of my Daughter Rachel's share be 
taken charge of by my two Brothers In trust for her use and 
subject to the same conditions as the produce of the monied 
property already bequeathed to he My Chambers Dictionary in 
four folio Volumes I leave to my Son Thomas Also a family 
silver Castor to my Daughter Elizabeth and a silver box with 
the Initials of my late dear Mother's name ..... to my 
Daughter Rachel All my furniture of every description I 
bequeath to my two Daughters either to be divided between 
them or sold as may be deemed most suitable and the produce 
divided between them share and share alike In the division 
of my property I have left a small matter more to my 
Daughter Elizabeth than to Rachel thinking she had a claim 
to that distinction on different accounts as being the 
Eldest as having paid such affectionate attention to my dear 
Wife during a long and trying illness and as having used 
considerable exertions in assisting to acquire a part of 
that property that I have now disposed of I hope my dear 
Children may feel satisfied at the distribution I have here 
made of what Providence has been pleased to favour with And 
I hope my dear Sons will not conclude that I have dealt too 
liberally with their Sisters when they reflect on the 
comparative greater difficulties females often have to 
encounter than those of the other sex in procuring a 
comfortable subsistence When this circumstance is taken into 
consideration and the difference of the length of the leases 
of the sundry parts of the property here bequeathed I expect 
it will be seen that I have endeavoured after a pretty 
equitable division of the same I hereby nominate constitute 
and appoint my two brothers before mentioned as Executors of 
this my last Will and Testament Also as Guardians to my dear 
Children and I hope the latter will be particularly 
attentive to the advice of their Uncles and look up to them 
in difficult cases as supplying the place of a Parent And I 
expect they will be disposed to give them such hints for 
their future conduct in life as will be found to conduce to 
their best Interest
Altho' the Will inclosed herewith be not regularly signed 
and Witnessed yet I being now on my departure for England in 
case of my not being favoured to return safely again I wish 
my family to know that it contains my present wish for the 
disposal of my property And I desire that it may be adhered 
to just as if it was regularly signed Thos Binns Waterford 8

the County of Surrey Spinster and Eliza Binns of the same 
place Spinster who solemnly and sincerely affirmed that they 
were Dissenters commonly called Quakers as to the manner and 
character of the handwriting of the deceased 20 March 1826)
