Will: Finn, James Glover February 2, 1833 *********************************************** Ireland Genealogy Projects Archives Westmeath Index Copyright ************************************************ File contributed by: Rosalind Dunning ros.dunning@outlook.com March 17, 2018, 3:40 pm FINN, JAMES GLOVER FEBRUARY 2, 1833 Source: National Archives Kew England Written: February 2, 1833 Recorded: March 17, 2018 Extracted from her Majesty's Court of Prerogative in Ireland In the Name of God Amen I James Glover Finn of the Town of Athlone in the County of Westmeath Half Pay Lieut 56th Regt being of sound memory and recollection do make this my last Will and Testament hereby revoking all former Wills etc. that is to say In the first place I desire all my just debts to be paid after my decease at the earliest possible convenience in the next place I will and bequeath to my wife Eliza Finn alias Kelly All my personal property of every description whatever together with all debts due to me either as rents or arrears of rents or any money that I may be entitled to as left me by a Will or otherwise to have and to hold to her for her sole and seperate use without the interference or controul of any person or persons whatsoever to do with and dispose of as she may think proper I further will and bequeath to my said wife Eliza Finn all my part or share of the following properties viz. the piece of ground called the Sheep Park near the Battenes and the houses and plots in Barrack Square and Queen Street in Athlone known by the name of Nalls Plot together with all my right title and interest in the house and concerns in Connaught Street called the triangular plot of which I have been promised a Lease by Colonel Lloyd for one life and 91 years to have and to hold to her during her life free from the control of any person whatever I further will and bequeath to my said wife Eliza Finn half the rents arising out of the estate of Couliskbeg in the County Longford to have and to hold to her during her life with power and authority for her to leave and bequeath to whom she may think proper the sum of one hundred pounds to be raised off the said Couliskbeg and to be paid in four years after her decease without interest lent should it not be paid at the expiration of four years then and in that case the said one hundred pounds or as much thereof as remains due shall pay the legal interest of the Country until the entire is liquidated or paid according to the will or desire of my said wife Eliza Finn I further will and bequeath to my sister Maria Finn all that and those the parcel or piece of land part of the before mentioned sheep park now in the possession of Patk Moran and Patk Kelly containing in or about seven acres which ground has been made over to me by Deed of Assignment by me nephew John O'Flinn eldest son of my late brother John to have and to hold to her her heirs and assigns as fully and completely as it is in my power to do so without the control or interference of any person whatever I further will and bequeath to my said sister Maria the other half of the rents arising out of the estate of Couliskbeg to have and to hold to her during her life with authority to incumber said Couliskbeg with the sum of one hundred pounds in every respect and under the same restrictions exactly as I have prescribed to my before mentioned wife I also will and bequeath to Thomas Courtenay my wife's nephew and to Henry Flood my own nephew at the decease of my beforementioned wife all the property which I bequeathed to her during her life Viz. Sheep Park Nalls Plot Triangular Plot in and near Athlone together with the half of the rents arising out of Couliskbeg to have and to hold to them in the manner following that is to say to Thomas Courtenay during his life and should the said Henry Flood die then the said Thomas is to have his share also during his life and in like manner should Thomas Courtenay die the said Henry is to have his share but during both their lives they are to share it equally between them share and share alike But in case Henry Flood shall have male or female issue lawfully begotten then the entire is to go to such issue but in case Henry Flood shall die without leaving such issue then and in that case it is my Will that the entire shall be divided between all my other nephews and nieces share and share alike without however any of them having power to sell or dispose of any part thereof but should any of them die then his or her share is to be divided among the survivors and so on as any of them may die the survivors are to share that of the deceased between them until there is but one survivor then and in that case he or she may dispose of said Couliskbeg and all other property which he or she may derive from me as he or she may think proper I further will and bequeath to my worthy and esteemed friend Biddy Lackey the sum of twelve pounds a year during her life to be paid by my wife out of the property which I have devised to her to commence payment whenever the said Biddy shall think fit to withdraw herself from the habitation of my said wife but should she the said Biddy continue to reside with her then the said sum of twelve pounds a year is to go for the said Biddy's maintenance and support and should my said wife die before said Biddy Lackey whoever shall be in possession of the property out of which Biddy was to receive said annuity he or she shall pay same and it shall be lawful for said Biddy to distrain for any part thereof that may be due during her life I trust and hope that no misunderstanding may arise on the subject of this Will as I have as clearly as I could set down my intentions and that no quibble or technical informality shall be construed into anything but my exact meaning I further nominate and appoint my wife Eliza Finn alias Kelly Sole Executrix of this my last Will and Testament In Witness whereof I affix my seal and subscribe my signature this second day of February one thousand eight hundred and thirty three The whole of this document is written in my own handwriting James G Finn Witness Geo: R Mathews _ Benj...........
