29, 2017 In the Name of God Amen I John Malone of Cartrons in the County of Westmeath Esqr being Sick in body but of sound and disposing mind and memory Praise be to God do make this my last Will and Testament in manner following ffirst I recommend my Soul into the hands of Almighty God and my Body to the Earth to be Interred at Clunmacknoise with my Ancestors but at a Moderate Expence such as my Executors herein after named shall think reasonable with regard to the Circumstances of my ffamily And as to the Temporal Estate which God hath been pleased to bestow upon me I Will and my Will is that my said Executors shall as soon as the same may be done conveniently after my death sell and dispose of all my Goods and Chattels reall and personal Except as is herein after Excepted and turn the same into ready money and that by with and out of the said money And also by with and out of such ready money as I shall be possessed of at the time of my death pay all the Debts I Owe for Servants' Wages by Simple Contract Book Accounts or Notes or by any Bonds or Obligations upon which no Judgement is entered shall in the first palce be paid and Satisfyed And that in the next place all such Debts as I owe by Judgement for the Satisfaction of which no other Fund is already Appointed shall be paid thereout and the residue of my said Personal Estate if any such shall be I Order and direct to be paid in discharge of my reall Estate as far as the same will go And my Will is that if my said Personal Estate shall not be Sufficient to Satisfy and pay my said Debts my real Estate shall stand and be Charged with such of my said debts as shall remain unpaid after a due Application of my said Personal Estate I devise and bequeath unto my Dear Wife for her own use All my Plate Household Goods and Furniture of what nature or kind soever My Will further is And I do further devise the sume of two hundred pounds apiece to my Children Lettice Malone Margaret Malone Margery Malone and Michael Malone to be paid them severally at their respective Ages of twenty one years with Interest for the same in the mean time at the rate of five pounds Ster Per Cent per Ann for their maintenance the said Portions and Maintenance to go first out of my Chattells reall and personal next after my Debts paid And in case the said Chattells real and personal be not Sufficient to Answer the same then the said Maintenance and Portions to stand a Charge on my real Estate and to be thereout paid my Will further is and I do hereby devise that whatsoever Sume or Sums of money is or are due or payable to me from or by Edmond Malone Esqr my Father at his decease by Virtue of any Articles Covenants or Agreements executed by him The same shall be received by my said Executors and be applyed and disposed of as far as the same will go in discharge of the said Portions so devised to my said Children if the said other Funds be not sufficient for that purpose To the .... and intent that thereby my said real Estate may be freed and discharged of and from the said Portions or so much thereof as the same will Satisfye And that when the said money is payable the same shall be layd out upon good Security at Interest for the benefit of my said Children And as their Maintenance may from thenceforth Issue out of the same and my real Estate be discharged of and from so much of the said Portions and Incumbrances as the Principal and Interest of the said money will amount unto And I do nominate constitute and appoint Anthony Malone and Thomas Wakely both of the City of Dublins Esqrs and the Survivor of them Guardians and Guardian of my Sons ffrancis Malone and Michael Malone and to have the Care and tuition of them and the Care direction and Management of their several ffortunes and Estates during their respective Minoritys and I make constitute and appoint my said ffrancis Malone and Michael Malone and the Survivor of them Executors of this my last Will and Testament of and for all my Goods and Chattles in the Kingdom of Ireland And during their Minority I make and appoint my Dear Kinsman Richard Malone Senior of the City aforesaid Esqr Executor of this my last Will and Testament for and touching my said Goods in the Kingdom of Ireland In trust nevertheless for my said Sons I also make and appoint Anthony Powell of Catrahene in the County of Glamorgan Esqr Executor of my Goods and Chattles in Great Britain to remit the Value thereof to the said Richard Malone for the benefit of my said Sons or the Survivor of them All which I declare and
