Will: Johnston, Edward October 7, 1795 *********************************************** Ireland Genealogy Projects Archives Wicklow Index Copyright ************************************************ File contributed by: Frank Kehoe f784@btinternet.com March 29, 2016, 8:46 am JOHNSTON, EDWARD OCTOBER 7, 1795 Source: Na, Kew Written: October 7, 1795 In the Name of God Amen I Edward Johnston of Droumin Lodge in The County of Wicklow and Kingdom of Ireland Esquire being of sound and disposing mind and memory do make and publish this my last Will and Testament in manner following hereby revoking and making null and void all former Will and Wills: heretofore by me made I leave and bequeath unto my Dear Wife Jane Johnston One hundred pounds to be paid her immediately after my decease I also leave my said Wife my Interest in the Lease and Lands of Dromin Lodge where I now reside as also my Interest in the Lands of Kelleckabawn with full power to dispose of the same as my Wife shall think proper I leave unto my said Wife her Watch Jewels and all her other paraphenalia appertaining to her person and also my Carriage and Carriage Horses and Milch Cows and my Wine at Dromin Lodge I also leave unto my said Wife for her life my Plate Linen Books furniture and all implements of Husbandry as shall be in and about my House at the time of my decease and after the decease of my said Wife I leave the said Plate Linen Books and furniture to my son Nicholas George and whereas my said Wife in case she shall survive me will be intitled for her life to her Yearly Interest of a sum of Six thousand pounds* so invested in Trustees by certain articles bearing date the twenty ninth of July One Thousand seven hundred and eighty five entered into previous to my Marriage for the purpose of securing the yearly Interest thereof to my said Wife for her life in case she should suvive me which Interst I consider as too small a provision for my said Wife therefore in addition thereto I leave and bequeath unto my said Wife for her life One Annuity or yearly Sum of One hundred and forty pounds Sterling to be ifsuing and payable out of my Estate in the County of Armagh and to be paid by two even payments on every first day of May and ----- first day of November in each year the first payment thereof to be made on the first of the said days as shall next happen after my decease and in case the same shall not be paid in forty one days after the day whereon the same ought to be paid I impower my said Wife to Distrain the said Lands or any part of therin for the same and the distrefses there found to dispose of according to Law until the said Annuity and all arrears thereof and all costs charged and expences attending the recovery of the same shall be fully paid off and satisfied and I declare the provision herein made for my said Wife to be in lieu full bar and satisfaction of all Dower or Thirds which she could have or claim out of such real freehold and personal Estate as I shall die seized pofsed of or intitled unto and as to for and concening the said sum of Six thousand pounds I direct will and appoint that immediately after the decease of my said Wife that same shall be raised by my Good friends Andrew Strahen of the City of London Richard Moland of Springfield House both in the Kingdom of Great Britain Esquires The Revd. Thomas Brownrigg of Kilquade in the County of Wicklow Clerk and John Brownrigg of the City of Dublin Esquire Barrister at Law and the Survivors and Survivor of them his Executors or Administrators and that my said Trustees and the Survivors and Survivor of them shall stand pofsed thereof upon Trust and for the use of such of my Children or such other person or persons His Her or their Executors Administrators and Afsigns as shall in virtue of be devises herein after mentioned become intitled to my said County of Armagh Estate I leave devise and bequeath unto my Son John Beresford Johnston the Sum of Three thousand pounds Sterling and to my Daughter Sidney Johnston the sum of Three thousand pounds Sterling to be paid unto my said Son and Daughter on their attaining their respective Ages of twenty one years or day or days of marriage which shall first happen and which said respective sums I charge upon such real freeholds and personal Estate as I shall be seized pofsed of or intitled unto and as to all my real freehold and personal Estate of every nature and kind whereof I shall be seized pofsed of or intitled unto Save and except such part of my said personal Estate as I have hereinbefore ??etipcally bequeathed Subject and charged as aforesaid and as herein mentioned I leave and bequeath the same and every part thereof unto the said Andrew Strahen Richard Holand Thomas Brownrigg and John Brownrigg Upon Trust and for the uses following that is to say Upon Trust that they the said Trustees or any two of them or their Survivors and Survivor of them shall therby and thereout by such ways and means as to them shall seem most proper raise and levy a sum of money sufft to pay my Just Debts Legacies and funerial Expences and from and after payment thereof I leave devise and bequeath such part and parts of my said real freehold and personal Estate as shall so remain unto my Son Nicholas George Johnston his Heirs Executors Administrators and Afsigns for ever but in case my said Son Nicholas George shall happen to die before he attains his age of twenty one years then I leave the said residium to my said Son John Beresford and in that case I devise unto my said Daughter Sidney a futher Sum of Three thousand pounds Sterling to be paid and payable to my said Daughter on her attaining the age of twenty one years or day of marriage which shall first happen and in case both my said Sons shall die before either of them shall attain his age of twenty one years as aforesaid then and in such case I appoint my said Daughter Sidney my residuary Lagatee and in case my said Daughter Sidney shall happen to die before she shall attain her age of twenty one years or be married then I leave the said residium of my fortune to the eldest son of my Brother William Johnstone and the Heirs Male of such eldest Son lawfully to be begotten and in failure of such Heirs Male to the second third fourth fifth and every other Son and Sons of my Brother William and their Heirs male lawfully ifsuing as they shall be in seniority of age and priority of birth and in default of such ifsue to the Daughter or Daughters of my said Brother and their Heirs lawfully begotten share and share alike as tenants in Common and not as joint Tenents and failing said Daughter or Daughters and their ifsue lawfully begotten then to my own right heirs provided always and it is in my Will that in case either my Son John or Daughter Sidney shall die before he or she shall attain their age of twenty one years or day of marriage then I leave and bequeath the portion of which ever of them shall so happen to die to the Survivor of them I also leave to my Good friends Mrs Malone and Mrs Edge the sum of --------------- each for a mourning ring I appoint the said Andrew Strahen Thomas Brownrigg and John Brownrigg Executors of this my Will and I appoint my Dear Wife and the said Andrew Strahen and Richard Moland Guardians of the persons of my said Children during their minority and the said Thomas and John Brownrigg Guardians of such part of the fortune of my said Children as shall in Lands or invested in Securities in Ireland and I appoint the said Andrew Strahen Guardian of such part of the fortune of my said Children as shall be within the Kingdom of England ?ereby giving and granting unto the said Thomas Brownrigg John Brownrigg and Andrew Strahen collectively or individually full power and authority from time to time to lay out and expend such amounts as they or any two of them or the Survivor of them shall think proper and seem necsfsary for the support maintenance and education of my said Children or any of them during their respective Minorities provided that such ?????? shall not infringe or break in on the provision so made for my said younger Children or either of them it being my Will that my said younger Children or the Survivor of them shall have their principle money whole and entire when they or the Survivor of them shall become entitled thereto In Witness whereof I the said Edward Johnston have hereunto and to a duplicate hereof set my hand and affixed my Seal this eleventh day of October One thousand seven hundred and ninety five Edwd. Edward Johnston Esquire died 18th Jan 1796 and is buried in the old graveyard Delgany in the same plot as his son Edward Cary Johnston (baptised 1/7/1786). William Henry Johnson, son of Edw. Esq., Drummin, was buried in Delgany 28/4/1791 and Araminta Johnston, dau. of Edw.
