File relating to the will of Sophia Cooke, late of the city
of Chester, who died in 1845. Some £200 was deposited in a
bank by Cooke and it was discovered only in the c. 1860s.
Cooke was a cousin of Richard Burton, Rutland lodge, county
Carlow, who together with his brothers (who are now
deceased) is entitled to a share of the money. File includes
letters between Burton and legal representatives relating to
division of the monies.

bequests (1) to his nephew, Sir Charles William Cuffe

the late [Sophia] Cooke etc (2) to Mary Dunne, servant, sum
of £20 over and above all wages owing to her (3) to all
other servants, the value of one-half year's wages. Sir
Charles William Cuffe Burton is appointed as executor. Copy
of grant of probate (15 September 1871) in the will also
present.

Description
Copy of bond of indemnity made between Richard Burton,
Rutland lodge, county Carlow, esquire, Hardy Eustace,
Castlemore, county Carlow, esquire, and Sir Charles William
Cuffe Burton, Pollerton house, county Carlow, who are bound
to Samuel John Roberts, city of Chester, esquire, in the
penal sum of £200 sterling to be paid to Roberts. Recites
details of the will of Sophia Cooke, late of the city of
Chester, who by her will dated 19 April 1846, bequeathed the
residue of her estate equally between the children of her
aunt, Lady Catherine Burton. Cooke appointed Roberts to be
her executor. By a later codicil, Edward Burton was given an
equal share in the estate. After Cooke died, Roberts proved
her will and the surviving children became entitled to total
sum of £1776.16. However, it has since been ascertained that
the sum of £200 deposited by Cooke in a bank was overlooked
and has only recently come to the attention of Roberts. It
is now for division between the residuary legatees. Richard
Burton is entitled to a one-third share. The residuary
legatee of Edward Burton was his wife. Her residuary legatee
is her nephew, Hardy Eustace, who is also entitled to a
one-third share of the £200. The third residuary legatee of
Cooke's will was George Francis Burton who died intestate
and whose next of kin is Richard Burton. Great expense would
be incurred in proving these facts so Roberts has agreed to
pay to Richard Burton the share of George Francis Burton.
Richard Burton, together with Hardy Eustace and Sir Charles
William Cuffe Burton now indemnify Roberts against any
further claims on him in connection with Cooke's estate.

contains 55 acres, 1 rood and 3 perches plantation measure.
Annual rent of £102.19.6. Lease to run for lives, two of
them unexpired; incomplete letter (4 June 1872) from Sir
Charles William Cuffe Burton to [Thomas C. Butler,
solicitor] that he wishes the lease to go to a 'Gentleman
(not a mere farmer) and a Protestant [underlined]'; includes
letters making offers for the property.

Description
File relating to the purchase of stock by trustees of the
marriage settlement executed on the marriage of Sir Charles
William Cuffe Burton and his wife. Includes two memoranda.
The earlier memorandum (5 July 1880) states that in June
1880 the London and North Western Railway Company allotted
to the trustees of the marriage settlement the sum of £560
in respect of stock held in that company by the trustees. As
this was not an authorised investment the trustees sold the
right to the allotment which realised the sum of £242.4.0
and later invested from this the sum of £222.17.2 in India
4% stock; the second memorandum (30 June 1887) states that
the 4% stock was exchanged for India 3½% stock.

Statement by Georgiana Mary Burton, wife of Sir Charles
William Cuffe Burton, in relation to the marriage settlement
executed on her marriage. Dated 14 December 1861. Statement
is addressed to Thomas Yorke Dallas Yorke, esquire, and
Mortimer, 1st Baron Sackville, the surviving trustees of the
settlement. She instructs the trustees to pay all dividends,
interest and income to which she is entitled under the
settlement to her husband's account with Messrs Cocks,
Biddulph and Company.

Charles William Cuffe Burton, Pollaction (Pollerton), county
Carlow, of the first part, Thomas Yorke Dallas Yorke, Army
and Navy Club, St James' square, county of Middlesex,
esquire, and Mortimer Sackville West, 1st Baron Sackville,
Knole, of the second part, and Sir Charles William Cuffe
Burton, of the third part. Recites marriage settlement dated
14 December 1861 made on the marriage of Sir Charles William
Cuffe Burton and his wife (see document P1/0523) under which
jointure of £800 was settled on Dame Georgiana Mary Burton.
Also recites details of indenture dated 1 August 1887 under
which lands held by Sir Charles were sold for £500. By this
current indenture, Dame Georgiana Mary Burton releases this
£500 from the £800 jointure and empowers the parties of the
second part to hold it in trust for her husband.

Hospital founded by Doctor Richard Steevens (Steevens
Hospital), of one part, and William Rochfort, Cahir Abbey,
Cahir, county Tipperary, esquire, and Thomas Kane McClintock
Bunbury, 2nd Baron Rathdonnell, Lisnavagh, Rathvilly, county
Carlow, of the other part. Recites fee farm grant dated 15
August 1867 (described as document number P1/0556) under
which the Governors of Steevens Hospital hold a premises. By
this indenture, the Governors agree to sell the premises to
Rochfort and Baron Rathdonnell for the sum of £170. It is
noted that this deed was registered at the Registry of
Deeds, Dublin, on 2 December 1915 in book 52, number 97.

charge of the Land Revenues of the Crown in Ireland. In
consideration of sum of £11.5.0 paid by William Rochfort,
Cahir Abbey, Cahir, county Tipperary, and Thomas Kane
McClintock Bunbury, 2nd Baron Rathdonnell, Gower grants them
quit rent amounting the annual sum of £0.8.6 due to His
Majesty. Quit rent to be held by them forever. Affected
lands are described as a messuage or tenement built with
several parcels of land containing 40 acres near Ballybought
bridge and in the possession of Thomas Crow. The original
tenant on the ancient crown rent roll is named as Sir James
Weymes.
