I Thomas Nowlan of Ballon in Carlow, Shopkeeper, am seeking payment
from William McAsssy of Myshall, Blacksmith, remaining due and
unpaid six pounds, two shillings and seven pence after all just
allowances as Thomas Nowlan doth verily believe.

This Statement is signed by "Kilwarden"
- - Viscount Lord Kilwarden ( Arthur Wolfe of Forenaughts, a
Kildare man) he served as Lord Chief Justice of the King's
Bench in Ireland.
He was piked to death by followers
of Robert Emmet on Thomas Street, Dublin on 23rd July during
the failed Rising of 1803.
He was travelling in a coach with his daughter, Marianne
and his nephew, Rev. Straubenze Wolfe, when their coach
was attacked by some of Emmet's group.
It is said that Lord
Kilwarden put his head out through the coach window and
exclaimed
"It is I, Kilwarden, Lord
Chief Justice of the King's Bench".
All three were dragged from
the coach by the mob, his nephew were piked to death,
his daughter Marianne was rescued by a local man who
brought her to his house on Thomas Street.
Lord Kilwarden was also piked,
he lived a short while, he died shortly after some
soldiers came to his rescue.
His last words were "murder must
be punished ~ but let no man suffer for my death, but on
a fair trial, and by the laws of this country".
In 1798 Lord Kilwarden made
representation to have Wolfe Tone's life spared. It was
hinted at the time that Wolfe Tone was the illegitimate
son of Lord Kilwarden
Lord Kilwarden acted as Judge at Carlow Court House on
many occasions.
A similar Statement to the one below states
that Martin Kelly is also suffering from a "dangerous fever" and unable
to attend at the same murder trial.]
Statement 1801.
Anastatia Barrett maketh Oath and Saith that
she this day saw James Nowlan of Liselican in the County of Carlow at
his house and that he was in his bed extremely sick of a dangerous fever
according to the best of her skill, knowledge and belief - That she has
been informed and verily believes that James Nowlan is a very material
witness on the trial of James Lannon and Margaret Kelly for the murder
of Patrick Kelly late of Laselican and that it is impossible for James
Nowlan to attend at this present Assizes without imminent danger of his
life.

Riotous
Disorderly Manner 1803
From the
PPP.
The
Information of Patrick Nowlan
and Thomas Ellard both of Ballon Hill,
Carlow, Labourers, taken under Oath before me one of his Majestys
Justices of the Peace for Carlow.
Partrick
Nowlan saith that between the hours of nine and ten of the Clock on the
night of Sunday the 27th day of November 1803 as he together with Thomas
Ellard were peacfully passing through the town of Ballon they were met
by the following persons Viz: Owen Cummins of Monmore with his three
sons Patt, James and Terence, Tim Maher and John Maher of Killane,
Labourers, Peter Regan (Rugan?) of Thurstown, Labouror, John Byrne of
Clonbolly, Labourer, Simon and Luke Nowlan of Meuing ?, Labourers and
Thomas Cummins, Monmore, together with several others unknown to the
Informants, all of them appeared in the most Riotous disorderly manner
carrying with them Clubs etc.
That then
and there the said James and Patrick Cummins most Violently Struck and
Knocked down the Informants without any provocation which Strokes has
greatly Bruized Patrick Nowlan about the head and eyes. When Patrick
Nowlan was Knocked down Owen Cummins laid fast hold of him and gave him
several Strokes and at the same time bid him not to ? (3 words ?).
Thomas
Ellard states that Terence Cummins Struck him without any Provocation.

of the Peace of our said Lord the King, whose Names the Jurors are
ignorant of, on the 27th Day of November in the 44th Year of the Reign
of our Sovereign Lord George the Third, by the Grace of God of the
United Kingdom of Britain and Ireland, King, Defender of the Faith, and
so forth, with Force and Arms, that is to say, with Swords, Sticks, and
so forth at Ballon in the County of Carlow, did then and there
riotously, routously and unlawfully assemble and associate themselves
together, and the said Persons being then and there so riotously,
routously and unlawfully assembled and associated together as aforesaid,
did then and there make a great affray contrary to the peace of our said
Lord the King, his Crown and Dignity.

11th Day of February 1804
John Nowlan being duly sworn on the Holy
Evangelists and examined saith that on Friday the 10th of February 1804
between the Hours of five and six O'Clock in the Afternoon as John
Nowlan was at the Out-Offices of Major Cornwall in Myshall he saw Anne
Morris alias Harland - House-Maid to Major Cornwall - with a Parcil
under her Arm, John Nowlan thought with the intent of milking Cows, soon
after John Nowlan saw Anne Morris alias Harland meet Benjamin James of
Myshall at the Out-Office and as soon as she passed by him he saw her
draw a Pistol from under her Clothes and present it at Benjamin James
saying she would shoot him -- shortly after John Nowlan heard a Noise
outside the Yard and upon him going to the Yard to see what was the
matter he saw Anne Morris alias Harland knock down Benjamin James aided
and assisted at same time by Thomas Harland, Gardener to Major Cornwall.

It is great when this happens, I just found the "murdered"
Patrick Nowlan in the Inquest reports from the Disraeli
Papers - now to try find the proper name and location of the
"burned" Riland house.

INQUISITION.
Alexander Johnson of the town of Carlow,
Surgeon, Saith that he attended this day at Garryhill, Carlow at the
Dwelling house of Patrick Nowlan, Deceased, as Alexander Johnson has
been informed and believes and Saith that this man having carefully
examined the Body found four wounds on his right Arm, four on the
Right Side of his Belly and one on the breast made by small balls
and Saith the said Gun Shot wounds in the Belly were the Cause of
his death as he found they had wounded his intestines.

[Note added by Michael Purcell 2012. This is
an iinteresting document on Parchment - - The signature at the end
of this petition is W. Downes, in 1806 he was Treasurer of the
King's Inns and Chancellor of Trinity College Dublin, in this case
he was presiding as Judge William Downes at Carlow Assizes.
Benjamin
Bunbury is well known to the regular readers on the Carlow IGP -
but
will any reader have information on Michael Paul Nowlan or the
"murdered" Patrick Nowlan or the proper name of the house mentioned
in this petition ?]

46th year of the Reign of our Sovereign Lord George the third by the

PETITION under the hand of Benjamin Bunbury,
Esquire, on behalf of Michael Paul Nowlan who is known to the
aforesaid Benjamin Bunbury, Esquire.
TO ~
The
Right Honourable William Downes.
THE KING against MICHAEL PAUL NOWLAN.
Michael Paul Nowlan the prisoner in this
case maketh Oath that on the 18thJuly 1806 he was Committed to the
Gaol of Carlow by a Warrant under the hand of John Staunton
Rochfort, Esquire, charging him with several robberies alleged to
have been committed by him in the County of Carlow.
Michael Paul Nowlan Saith that in
consequence of the Committal Warrant not stating any specific
offence it was impossible for him to prepare for his trial.
He further Saith that on the 22nd day of
July 1806 only five days before the present Assizes another Warrant
was lodged on him by Francis Dillon, Esquire, charging him with have
been concerned in aiding and assisting at the burning of Rilard
house [? could be Niland house - - any suggestions ?, Tinryland?]
and the murder of Patrick Nowlan on the night of the 11th of January
1805.
Michael Paul Nowlan Saith that from the time
of the last Warrant of Committal was lodged he has endeavoured to be
ready to abide his trial for alleged burning and murder.
He further Saith from the shortness of time
between his Committal and the present Assizes he hath not been able
to be fully prepared for his trial.
Michael Paul Nowlan further Saith that --
O'Grady, and -- Maguire whose Christian names he doth not know, but
who are Sergeants in his Majestys One Hundred and First Regiment
quartered at Newry nearly One hundred miles from the town of Carlow,
are necessary and material witnesses for him at his trial and
without the benefit of whose testimony he cannot with safety abide
his trial.
Michael Paul Nowlan further Saith it was not
until yesterday in preparing for his defence that he discovered the
necessity he was under to procure the attendance of O'Grady and
Maguire at the present Assizes.
Michael Paul Nowlan further Saith he hopes
and expects and will use his best endeavours to procure the
attendance of the said persons.
AND THEREFORE Michael Paul Nolwan humbly
prays his trial to be postponed, he does not make this application
for the purpose of giving any unnecessary delay to his trial.
He further Saith that since he hath been in
custody and the Impressions against him on the public mind from the
seriousness of the offences with which he is charged making it
particularly necessary for him to be fully prepared for making his
defence and thereby proving his innocence.

Carlow.
The Information of Bridget Kearavan of Kilkea in the County of Carlow
who being Sworn on the Holy Evangelists Say that on Thursday the 19th
day of September last
Bridget being then and for some time previous thereto employed by Anne
Clowry of Kilkea, Carlow was on the lands of Ballykealy, Carlow on her
Mistress's Business was assaulted and Struck with a pitchfork without
any provocation by Easter Nowlan of Kilkea, Carlow and that on
Saturday following being the 21st Sept. she was waylayed on the land
of Drunaugh between Ballykealy and Kilkea by Mary Murphy, Sister to
Easter Nowlan, who then and there most violently assaulted and beat
her [page torn].
She was obliged [ page torn ] Some time in consequence of such
treatment.

The Information of Bridget Nowlan of Ulland, Carlow, Spinster, taken
before me one of His Majestys Justices of the Peace, who duly sworn on
the Holy Evangelists Saith that on Sunday evening last she was going
to a Wake between the hours of six and seven O'Clock when she met
Peter Clowry son of James Clowry of Ballybrien, farmer, who told her
he wanted to speak to her and asked her to walk off the road into a
field, that on going into the field Peter Clowry thought to force his
hand into her pocket, which she prevented but got her's into it and
took out a promissory note off Peter Clowry, which he (?) to her for
the amount of Six pounds.
She also took out of her pocket two notes of the Bank of Ireland,
Value one pound each, Bridget Nowlan conceiving that Peter Clowry
wanted to rob her kept the notes tight in her hand, Peter Clowry then
? by the neck thinking to choke her and after some struggle he
succeeded in forcibly and feloniously taking the said promissory note
Value six pounds and also the two notes of the Bank of Ireland for one
pound each with which Peter Clowry made off on hearing the noise of
people approaching.
