Without his consent

There is another charge against the 6 men named above.

That they on the 10th of March in the 38th year of the Reign of our Sovereign Lord George the third King did at Mount Neal, Carlow between Sunset of said day and Sunrise on the Day next following did Cut down take and Carry Away one Deal Tree, Value 5 shillings, One Ash Tree, Value 3 shillings and one Oak Tree, Value 10 shillings the goods of Francis Paul Stratford, Esquire without his consent, he being the Owner thereof.

14th day of March 1798

From Jean Casey, 4th December. 2009, Very difficult to transcribe but here is the main trust of the charge recorded in the Browne-Clayton Papers.

Patrick Hore along with John Currin , Oliver Carey , Christopher Beaghan, John Howlett, James Muldoon were committed by Philip Newton, Esquire, on 14th March 1798. That they being evil disposed and Designing persons on 10th March in the 38th year of the Reign of our Sovereign Lord George the third King did at Mount Neal, Carlow Wickedly Unlawfully Mal ? and felon ? did Conspire Confederate and Agree together to and with certain other persons Willfully and of Malice prepared to Kill and Murder the Honorable and Reverend Francis Paul Stratford against the peace of said King.

26th day of March 1798

A Kallender of Prisoners left in the Custody of Edward Eustace Esquire, Sherriff of the County of Carlow. 26th day of March 1798.

1 - Patrick Collins to be hanged pursuant to Warrant Delivered.
2 - James Mitchell to be burned on the hand and Imprisoned for the Space of one year and then to be discharged paying fees. £1-7-9p
3 - Pat Fluskey, Bryan Sharkey and John Doyle to be hanged pursuant to Warrants Delivered.
4 - John Currin, Oliver Carey, Patrick Hore, John Howlet and James Muldoon to be hanged pursuant to Warrant Delivered.
5 - Patrick Maher, Edmond Maher and John Kinshelagh to be Imprisoned for one year Each And to be whipped pursuant to Warrant Delivered. And to give Security before a Magistrate to be of the peace and Good behaviour for Seven years and then to be Discharged paying fees Each. £1-15-6p.
6 - John Lawor to remain in Gaol until next assizes to abide his Trial for a Certain Offence.
7 - Timothy Nowlan to be Transported for Life pursuant to the Statute.
8 - James Cullen to remain under the Judgment of Death pronounced upon him - No day Appointed for his Execution.
9 - Thomas Reynolds to remain untill he gives Security before John Stewart, Esquire, a Justice of the Peace for the said County of Carlow. himself bound for £400.00 and two Surities of £200.00 Each Conditioned to be of the peace for 7 years then to be discharged paying fees.
10 - Tobis Byrne to be Transported for Life pursuant to the Statute.
11 - John Kelly and Edward Kelly to be Whipped and imprisoned and give Security pursuant to Warrant Delivered and then to be Discharged paying fees Each.
12 - Christopher Beaghan Convicted of a Capital felony Therefore Ordered to remain in Custody but no Judgement pronounced upon him.
13 - Timothy Nowlan to be Transported for Life pursuant to the Statute.
14 - Pat Rice to be imprisoned for the Space of one year.
15 - James Doyle and Timothy Doyle to be discharged on Enlisting ~.
16 - Andrew Kegan or Hegan , John Kegan or Hegan, Pat Kegan or Hegan to remain in Gaol to be tried at the Sessions.
17 - Silvester Cavanagh or Tobin to remain in Gaol untill he gives Security.
18 - Pat Keegan and Denis Keegan to remain in Gaol untill they give Security.
19 - Thomas Linan to remain in Gaol untill he gives Security before Robert Cornwall.
20 - Peter Carroll to remain in Gaol.
21 - Patrick Fahy to be Transmitted pursuant to Warrant Delivered.
Received the above Warrants.

A Kallender of Prisoners left in the Custody of Edward Eustace, Esquire, Sherriff of the County of Carlow at a General Assizes and General Gaol Delivery held at Carlow on the 26th day of March 1798 and in the 38th year of the Reign of our Sovereign Lord George the third by the Grace of God of Great Britain, France and Ireland King, Defender of the Faith and Soforth.

Before The Honourable Robert Day, fourth Justice of his Majesties Court of Chief place in Ireland and The Honourable John Toler his Majesties Solicitor General in Ireland.

JUSTICES and COMMISSIONERS of our said Lord the King aforesaid by the Letters Patent of our said Lord the King to take all the Assizes, Juries, Recognitions and Certificates before any Justices whatsoever taken.

AND ALSO assigned from time to time to deliver the Gaol of our said Lord the King of the said County of Carlow of All the Prisoners and Malefactors therein being.

AND further assigned to hear Examine discuss and determine of All and Singular Treasons Murders Manslaughters Burnings Felonies Unlawful Assembles Extortions Oppressions and All Crimes Contempts evil doings and Offences whatsoever Committed or to be Committed in the said County of Carlow.

BY VIRTUE of a Commission of our said Lord the King, Under the Great Seal of his said Kingdom of Ireland bearing Date at Dublin the Third Day of March in the 38th year of the Reign of our said Lord the King.
