Burton. In codicil (30 January 1812) writes that Benjamin
Burton is now deceased and now bequeaths aforesaid
properties to his second son, also named Benjamin Burton.

Description
Assignment of judgement made between William Curtis,
Annaghmore, King's county (Offaly), esquire, of one part,
and William Middleton, Mullingar, county Westmeath, esquire,
of the other part. Recites that during Easter Term 1802, Ann
Preston, widow of Reverend Plunket Preston, obtained a
judgement in the Court of King's Bench in Ireland against
Robert Curtis, Inane, county Tipperary, esquire, in the sum
of £1,600 sterling plus costs. The interest of Ann Preston
in the judgement is now vested in William Curtis. The sum of
£810.9.11 is now due on the judgement and William Middleton
has agreed to advance this sum to Curtis on an assignment of
the judgement. It is noted that a memorial of the assignment
was entered in the Prothonotary's Office of His Majesty's
Court of King's Bench in Ireland on 7 August 1811, number
103.

Description
Assignment of mortgage and judgement made between William
Curtis, Annamore, King's county (Offaly), esquire, of one
part, and William Middleton, Mullingar, county Westmeath,
esquire, of the other part. Recites that Daniel Toler, late
of Beechwood, county Tipperary, esquire, deceased, did by
his will dated 2 April 1796 devise the lands of Knigh
(otherwise Castleploough and Bewley), barony of Lower
Ormond, county Tipperary, together with the mansion house,
offices, gardens and woods thereon to Robert Curtis, Inane,
county Tipperary, esquire, and Sarah Anne Curtis otherwise
Toler, his wife, second daughter of Daniel Toler. In his
will, Daniel Toler empowered his daughter to raise the sum
of £1,000 on the lands. The Curtis' became seized of the
lands after Toler's death. Recites details of deeds of lease
and release dated 17 May 1802 and 18 May 1802, the deed of
release being made between the Curtis' and Anne Preston,
parish of St Anne's, Dublin, widow of Reverend Plunket
Preston, parish of Dunbrileague, county Limerick, whereby
the Curtis' mortgaged the aforementioned lands for sum of
£800 at rate of 6% interest to be repaid by 18 May 1803.
Preston obtained a judgement against Robert Curtis
conditioned for the payment of £800 plus interest. This
judgement is now vested in William Curtis and the sum of
£800 is due on the mortgage and judgement. William Curtis
assigns the mortgage and judgement to William Middleton in
consideration of the sum of £800 paid by Middleton to
Curtis. It is noted that this deed was registered at the
Register Office, city of Dublin, on 7 August 1811 in book
640, page 484, number 438586.

esquire, deceased, of the other part. States that Sir
Charles is seized of the rent and reversion in lease dated
10 May 1756 (details of this lease are given in description
for document number P1/0414). Also that Robert Phipps is
seized of the interest in the premises demised in this lease
and is entitled to a renewal in trust for Isaac Barre
Phipps, only son of William Phipps, who is a minor. Renewal
is granted in respect of two fields containing 7 acres, 2
roods and 12 perches at Cullenswood, county Dublin.

Description
Mortgage made between Sir Charles Burton, Pollerton, county
Carlow, of one part, and Reverend Edward Herbert, city of
Dublin, Master of Arts, Archdeacon of Aghadoe, trustee of a
deed of settlement executed on the marriage of the said Sir
Charles Burton and Catherine Cuffe (marriage settlement
described as document number P1/0249). Recited in this
marriage settlement that certain lands, part of the estate
of Richard Thornhill, esquire, had been previously granted
to trustees to permit Sophia, Lady Desart, in case she
should survive Thornhill, to charge the premises with a sum
not exceeding £3,000 with interest at 5%. Sophia, Lady
Desart, appointed the sum of £966.13.4 as Catherine Cuffe's
portion of the sum of £3,000. By Sir Charles and Catherine
Cuffe's marriage settlement, this sum, together with two
other sums of £5,000 and £2,666.13.4 were vested in William
Cuffe and Joseph Hoare upon trust (except for sum of £1,000
given to Sir Charles for his sole use). States that both
trustees, William Cuffe and Joseph Hoare, have died and
Herbert, party hereto, is appointed trustee in their stead.
The sum of £966.13.4 plus interest amounts to £1466.13.4 was
paid to Sir Charles as a result of a court case. The sum
spent by Sir Charles during the court case exceeds the
amount recovered. Now, Sir Charles owes the sum of £966.13.4
to the trust. Herbert has further lent the sum of £227.4.0
to Sir Charles from the trust fund. Sir Charles has agreed
to secure the two sums by mortgage on the lands of
Knocknabodaly (Knockbodaly), county Kilkenny, and the lands
of Dungansallagh (Dangansallagh), county Tipperary. Mortgage
to be null and void if the sums of money are repaid with
interest within one year.

Richard Burton, George Burton and Edward Burton, esquires,
and Catherine Burton, Grace Anna Burton, Elizabeth Burton
and Sophia Burton, spinsters, younger children of Sir
Charles Burton and Lady Catherine Burton (otherwise Cuffe)
against Reverend Edward Herbert. Document outlines details
of marriage settlement executed on 4 August 1778 on the
marriage of Sir Charles Burton and his wife. Later,
Archdeacon Edward Herbert and his son, Reverend Edward
Herbert, became trustees to the marriage settlement. At
various times, they converted stock, part of the trust fund,
to the value of £2,000 and £1,400 to their own use. This
draft bill is addressed to Thomas, Lord Manners, Lord
Chancellor of Ireland, to resolve various issues associated
with the Herberts' actions.

made 27 May 1820 between Sir Charles Burton, of the first
part, Charles Francis Brabazon, of the second part, George
Frederick Winstanley, of the third part, and William Parsons
Hoey, of the fourth part, whereby in consideration of the
sum of £850, Sir Charles grants to Brabazon an annuity of
£114.12.10 chargeable upon certain lands. For the better
securing of payment of the annuity Sir Charles demises
certain lands to Winstanley. A dispute has now arisen and
advice sought on behalf of Sir Charles. Opinion of Walker
(19 August 1825) is appended.
