Indenture of agreement made between William Weldon,
Gravelmount, county Meath, esquire, of one part, and Sir
Charles Burton, Pollerton, county Carlow, and Richard
Chaloner, Kingfort, county Meath, esquire, of the other
part. Recites details of a marriage settlement executed on
22 May 1792 and which pertains to the marriage of Weldon and
Lucy Cuffe, Pollerton. The present deed comprises agreement
whereby certain lands in county Meath are made chargeable
with a sum of money with a covenant to charge the same with
a further additional sum of £7,000. It is noted that this
deed was registered at the Register Office, city of Dublin,
on 3 May 1798 in book 512, page 434, number 335077.

deceased, of one part, and John Brownrigg, Ballylean, county
Carlow, gentleman, youngest son of Samuel Brownrigg,
esquire, deceased, of the other part. Recites lease dated 23
February 1738 made between Robert Burton and Joseph Loggan
in respect of a park containing 4 acres and 3 roods
plantation measure in the town of Carlow. Bounded on the
east by 'Mr Bernard's' holding; on the south by [Winnet's]
holding; on the west by 'Mr Whitestone's' holding and on the
south by the Dublin road. To be held for lives renewable
forever. Annual rent of £5.18.9 sterling. The interest of
the parties in the original lease is vested in the parties
to the current lease and a renewal is now granted.

Description
Abstract of title of Colonel Robert Burton to the lands
called Feltham's holding and Rainstonne (Rainstown), county
Catherlogh (Carlow). Title for Owen Feltham's holding begins
with lease dated 22 May 1712 from Henry, 8th Earl of
Thomond, to Benjamin Burton. These lands were granted in fee
farm to Burton by the Earl of Thomond on 26 September 1712.
Henry Berkely conveyed the lands of Rahinstonne to Benjamin
Burton by deeds of lease and release dated 20 September 1723
and 21 September 1723 respectively. Samuel Burton inherited
the lands from his father, the aforementioned Benjamin
Burton. The lands were then vested in trustees for the
relief of the creditors of Burton and Harrison.

The trustees conveyed the lands to Colonel Burton by deeds
of lease and release dated 28 July 1738 and 29 July 1738.

Statement by James Canville, Dynansallagh (Dangansallagh),
county Tipperary, to Sir Charles Burton. Lists objects that
have been stolen from him, for example, a cow, barrels of
potatoes and a bedstead, and which have been found with
named persons in the neighbourhood. Also that several
persons had animals grazing on his lands and did not pay him
for this privilege. Requests that justice be done by him.

Description
Letter from John Lahey to Sir Charles Burton. Writes that
his father, Thomas Lahey, tailor, was formerly Sir Charles'
tenant on the lands of Dungansallagh (Dangansallagh). Also
that the writer's sisters stole their father's cattle and
persuaded the father that the writer was the aggressor.
Lahey also alleges that his sisters wrote a will for their
father's estate in which the writer was disinherited and got
him to sign it when he was in a weak state a week before
death. Now requests Sir Charles, when he is leasing land, to
consider him for a tenure.

Description
Mortgage made between Robert Curtis, Inane, county
Tipperary, esquire, and Sarah Ann Curtis (otherwise Toler),
his wife, second daughter and devisee of Daniel Toler, late
of Beechwood, county Tipperary, esquire, deceased, of one
part, and Anne Preston, parish of St Anne's, Dublin, widow
of Reverend Plunket Preston, parish of Dunbrileague, county
Limerick, of the other part. By his will dated 2 April 1796,
Daniel Toler devised to Robert Curtis and Sarah Ann Curtis,
the lands of Knigh (otherwise Castleplough and Bewley),
barony of Ormond Lower, county Tipperary, with the mansion
house, offices, gardens and woods thereon. Also recites that
by his will, Daniel Toler empowered his daughter to encumber
the lands with sum of £1,000. Now, the aforementioned lands
are transferred to Preston in consideration of sum of £800
she gives to the Curtis'. Mortgage to be null and void if
they repay her this sum with interest of 6% by 18 May 1803.
It is noted that this deed was registered at the Register
Office, city of Dublin, on 5 June 1802 in book 545, page
214, number 60709.

Description
Deed of settlement executed after the marriage of Joseph
Faris and Margaret Burton, daughter of Sir Charles Burton.
Settlement made between Joseph Faris, city of Dublin,
barrister, of the first part, Margaret Faris (otherwise
Burton), his wife, of the second part, Sir Charles Burton,
Pollerton, county Carlow, of the third part, and John
Humfrey, city of Dublin, esquire, of the fourth part.
Recites that by deed of release dated 19 March 1714, Francis
Harrison, city of Dublin, esquire, demised to Charles Byrne,
Sleaty, Queen's county (Laois), and William Faris,
Ballinakill, county Carlow, the townland of Ballinakill,
barony of Rathvilly, county Carlow, containing 240 acres
plantation measure. Covenant for perpetual renewal in the
lease. Joseph Faris is now entitled to one-half of these
lands. Details of settlement executed on the marriage of Sir
Charles Burton dated 4 August 1778 (described as document
number P1/0249). Under this, he made provision for the
financial support of his children. Sir Charles now agrees to
provide sum of £500 to Joseph Faris as the marriage portion
of his daughter, Margaret Burton. In return, Faris places
the lands of Ballinakill upon trust to provide jointure for
his wife should she survive him, and makes provision for any
children of the marriage. It is noted that this deed was
registered at the Register Office, city of Dublin, on 26
January 1803 in book 544, page 428, number 365454.
Endorsement to the settlement also recorded.

Sir Charles Burton, Pollerton, county Carlow. Writes that
Sir Charles' tenants have resumed the [drainage]. Mentions
Mr Webb under whose direction the tenants are. Also writes
with a request for the Bishop of Killaloe. He wishes to know
if Sir Charles would give him a lease forever of the 13½
acres that Kennedy holds from Sir Charles. The Bishop would
build a glebe house on the land to the value of £400.

Assignment of mortgage made between Bartholomew Williams,
Woodville, county Kildare, esquire, of one part, and William
Curtis, Annamore, King's county (Offaly), of the other part.
Recites details of mortgage described as document number
P1/0338. Also, that Ann Preston obtained a judgement against
the Curtis' conditioned for the payment of £800. Preston's
interest in the mortgage and judgement is now vested in
William Curtis. He assigns the mortgage and judgement to
Curtis now in consideration of payment to him of the sums of
£800 and 5 shillings. It is noted that a memorial of the
assignment of the judgement was entered in the
Prothonotary's Office of the Court of King's Bench in
Ireland on 30 April 1811, number 455. It is also noted that
the assignment was registered at the Register Office, city
of Dublin, on 20 April 1811 in book 634, page 49, number
435633.

Description
Indenture made between Sir Charles Burton, Pollerton, county
Carlow, and Charles Burton, esquire, eldest son and heir
apparent of Sir Charles Burton, of the first part, Thomas
William Gahan, city of Dublin, gentleman, of the second
part, and John Humfrey, city of Dublin, of the third part.
Recites details of deeds of lease and release dated 3 August
1777 and 4 August 1777 [this should probably read 1778]. The
deed of release being the marriage settlement executed on
the marriage of the said Sir Charles Burton and Catherine
Cuffe (described as document number P1/0249). The current
indenture recites details of the marriage settlement,
namely, that Sir Charles Burton was seized of lands about
the town of Carlow containing 254 acres; also the lands of
Rathnapish, barony of Carlow, county Carlow; also the lands
of Pollardstown (Pollerton), county Carlow; also the lands
of Ballymore Eustace, commonly known as the Duke of York's
lands and a close or park commonly called Luckomb's park,
county Dublin. Sir Charles transferred these lands to
William Burton and Hunt Walsh forever subject to the chief
or fee farm rents subject to various trusts, that is, to Sir
Charles after his life and thereafter in tail male. Now, Sir
Charles Burton and Charles Burton transfer these lands to
Gahan upon trust that he may become perfect tenant of the
freehold of the lands. It is agreed that a recovery may be
had at the cost of the Burtons. It is also agreed between
the parties that it is lawful for John Humfrey to prosecute
before the end of the present Trinity Term in the Court of
Chancery in Ireland a writ of entry sur disseisin en le post
for lands against Gahan. It is noted that this deed was
registered at the Registry Office, city of Dublin, on 4 July
1807 in book 584, page 411, number 401934.
