motor car, the property of Mr. John Deering, Knockarda, Palatine,
Carlow, was seized by an officer
in charge of the Volunteers at Duckett's Grove and retained until
the 14th of February, 1922, when it was returned in a wrecked
condition; if on the 11th September, 1923, a claim for £150,
covering cost of repairs (£59 3s. 4d.) and the loss occasioned by
its detention, was lodged by Mr. J. J. Duggan, Mr. Deering's
solicitor; if, in the month of February, 1924, detailed particulars
of the claim, and subsequently a statutory declaration answering all
queries, were returned to the Army Finance Office; if, on the 25th

of March, 1925, claimant's solicitor was referred to the Indemnity
Claims Commission; if, on the 23rd and 26th of the same month, the
latter body were communicated with and the correspondence
acknowledged on the 8th of June, when information was given that the
matter was being dealt with; if several further communications have
been sent on behalf of Mr. Deering, which have not been
acknowledged, and if the Minister will take steps to have this
long-outstanding claim settled.

received by the Department of Defence and referred in due course to
the Committee appointed under the Indemnity Act, 1924.
Representations have been made to the Committee with a view to

to introduce legislation whereby the guarantors will be made safe,
and the land will be left so that it could be divided by the Land
Commission?

questions which, possibly, the Deputy could have asked me and in
reply to which I could have given him a considerable amount of
information; but I did not expect that he would make the case that
the old Sinn Fein Party told the people down there to give this
guarantee and that they would make it all right when they would come
into power. I never heard that. I may say that there are proposals
before the Minister for Finance for dealing with such cases as this.

whether he is aware that a large sum of money has been expended to
make the Home comfortable, and whether, in view of the fact that the
old union has been now rendered absolutely unsuitable owing to its
having been occupied by military, he will give an undertaking not to
remove the aged and the feeble from their present Home.

his attention has been drawn to an order of the
Carlow Board of Health compelling
patients to enter the County Home before sending them for special
treatment to Dublin hospitals, and whether, in view of the fact that
dispensary doctors have certified them as special and urgent cases
for treatment in Dublin, he will undertake to expedite matters
whereby patients can be sent direct.

Mr. BURKE: The Carlow
Board of Health have not issued an order compelling patients to
enter the County Home before being sent to Dublin hospitals. They
have issued an instruction to all dispensary medical officers that
all cases requiring hospital treatment should be sent to the nearest
available hospital under the control of the Board, and that no
recommendation for treatment in a Dublin hospital should be made by
any medical officer except the medical officer of the hospital. This
arrangement affords the medical officer of the hospital an
opportunity of seeing whether he can deal with the case in the local
hospital and obviates unnecessary expenses. In the circumstances I
consider the attitude of the Board of Health is reasonable and I do
not propose to take any action in the matter.

and Athy have to be forwarded on Tuesday in order to reach Cabra in
time for Dublin market on Thursday; that on this account a good deal
of additional expense is caused to farmers for the keep of their
animals in Dublin, and if he will urge on the Railway Company the
desirability of making arrangements to take stock at the stations
mentioned on Wednesday morning and deliver same in Dublin on same
day.

(6) (d), of the Act.

dated 11th October, 1925, the Secretary of the Board of Public Works
informed the County Council of Kildare that certain work involving
an estimated expenditure of £4,300 was about to be carried out on
the River Lerr in Counties Kildare and Carlow, to the cost of which work the County Council was
invited to be contributory, and for which landholders in the
drainage district would be liable to the extent of 4/9 per acre;
that at the meeting of the County Council several members acquainted
with the district expressed the opinion that, inasmuch as the stream
had been kept in good order by annual expenditure of money through
the Lerr Drainage Committee, the proposed operations were
unnecessary; that their conclusions were confirmed by the Committee
named and also by their engineer; that without any further
communication the Board of Works began the work, upon which over
£4,000 has already been spent and a further sum of £1,500 is
estimated for its completion; that landholders bordering the river
assert that no benefit has accrued or can accrue to them on account
of the undertaking, and if he will cause inquiry to be made as to
the reason for proceeding with the work.

the 4th July, 1925— not 11th October—that the Commissioners of
Public Works had been authorised by the Minister for Finance to
carry out a general restoration of the rivers and streams in the
River
[1608]
Lerr Drainage District, under the Drainage Maintenance Act, 1924.
The work commenced on the 25th of that month and was continued until
the 9th December following, and the expenditure for that period
amounted to £2,500.
-
On
the 23rd March, 1926, the Secretary of the Kildare County Council
forwarded to the Commissioners a copy of a resolution passed on the
16th idem, protesting against the expenditure as unwarranted and
inquiring on whose initiative the work was undertaken. On the 7th
ultimo the Council were informed that the Commissioners were
satisfied from the information they had that the district was not
properly maintained, a conclusion which was confirmed by their
engineer's report after inspection. It was at the same time
intimated to the County Council that if the latter thought it
desirable the Commissioners would recommend the extension of the
period of repayment from 10 to 15 years and thus reduce the average
annual charge from 4/9 to 3/7 per acre. There is no reason to expect
that the estimate for the work—£4,300—will be exceeded.

notwithstanding what Deputy Conlan says.

Thomas Dormer claimed Unemployment Benefit for himself and Increased
Benefit in respect of his child and housekeeper on the 12th July
last. He furnished evidence of unemployment from the date of his
claim up to the 28th July and again from the 4th to the 11th August.
The claim was disallowed on the ground that the claimant had lost
his employment by reason of a stoppage of work which was due to a
trade dispute at the Castlecomer Quarries, Ltd., where he had been
employed. Against this decision Mr. Dormer appealed to the Court of
Referees. As a result of subsequent investigation it was ascertained
that the trade dispute terminated on the 17th July, and after
further consideration of the claim by the Court of Referees and
Insurance Officer, benefit was allowed on the personal claim and
also in respect of the dependent child from and including the 17th
July. Payment will be made on next Friday. It has not been possible
to allow benefit in respect of the claimant's housekeeper, but that
part of the claim has been referred to the Court of Referees, which
sits at Kilkenny to-day for further consideration.

acquired for a similar purpose, and whether it is intended to take
any action in the matter.

comprising 67a. 2r. Op., owned by Mrs. Drea, who purchased them from
Mrs. Bagwell. The Land Commission instituted proceedings for the
acquisition of these lands. An objection was lodged by the owner to
their acquisition, which was heard by the Land Commission and
allowed.

what grounds an old age pension has been withheld from Denis Fenelon, Regent
Street, Bagenalstown.

The claimant was notified by my Department that an appeal on means had been
lodged against a decision of the Bagenalstown Pension Sub-Committee granting
him an old age pension of nine shillings a week. The letter of notification
was returned un-

delivered, as the claimant had changed his address.

The
Clerk of the Sub-Committee subsequently forwarded a new address, and the
case was referred for local investigation to one of the Department's General
Inspectors. He could not find the applicant, whose address was unknown
locally. In the circumstances the claim was disallowed on the 25th of
October last.

Would the Minister say how the particulars as to means were compiled in the
first case?

The claim was disallowed as I was not satisfied that the claimant's yearly
means were less than £39 5s. Od.

Is the Minister aware that this man was only living on charity and the
pensions officer put down £19 4s. Od. for lodging, 1s. per night, and that
he put down £10 8s. Od. for charitable donations from people? This man was
evicted at one time and got down and out. Is this the way we find that the
Minister is going to deal with persons like this?

DUBHGHAILL asked the Minister for Lands and Agriculture if he can state when
the Land Commission proposes to divide the 8,500 acres of untenanted
land in County Carlow.

Mr. HOGAN: The Land Commission have not yet actually acquired any untenanted
land in County Carlow under the
Land Act, 1923; but prices have been determined in respect of close
on 800 acres, which will shortly be vested in the Land Commission,
and will then be divided as soon as possible.

percentage of the 6,600 acres of untenanted lands in County Kilkenny
have been divided, and, if so, whether he can also state the number
of uneconomic holders who have been made economic, and the number of
landless men who secured portion of these lands, with the number

of acres each person received in the latter case.

Mr. HOGAN: Of the 3,284 acres of untenanted land in County Kilkenny actually
acquired by the Land Commission under the Land Act, 1923, up to the
present, 2,115 acres have been divided among 91 allottees for the
enlargement of existing holdings and the creation of new holdings,
and it is anticipated that the remainder will be divided before next
spring. Under the Irish Land Acts, 1903-9, 5,053 acres of untenanted
land have been divided in County Kilkenny.
